AN ORDINANCE AMENDING THE ZONING ORDINANCE, ORDINANCE NO. 850, SECTION 10-C.2.1.,
SECTION 10-C.2.2., SECTION 13-A.6.1., SECTION 13-A.6.2., AND SECTION 13-B.1. TO
PROVIDE FOR FILING FEES AND NOTIFICATION PROCEDURES FOR CONDITIONAL USE PERMIT AND
REZONING APPLICATIONS.
WHEREAS, the City Council held a public hearing in the City Hall at 7:00 P.M. on
Thursday, July 8, 1976 on the question of amending the Zoning Ordinance No. 850;
AND WHEREAS, the City Council has determined to amend Ordinance No. 850;
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS:
The Zoning Ordinance No. 850, is hereby amended to read as follows:
Amend SECTION 10-C.2.1. to read:
The application for Use Permit shall be filed with the City Planner and accompanied
by a check made payable to the City of College Station in the amount of $25.00 plus
$2.00 per property owner within 200' of the property defined in the application.
Said filing fee shall not be refundable. If due to the action of the applicant, the
hearing for a use permit is postponed, an additional fee of $25 plus $2 for notifying
each property owner within 200 feet of the property defined in application shall be
required. Until all fees have been paid in full, no action shall betaken on any
application or appeal. Such application may be filed at the time of application
for Building Permit or may be filed prior to such application for a Building
Permit; however, it must be accompanied by a plot plan showing the proposed
use of the land and buildings and must show the surrounding land use, in such detail
as necessary to clarify the claims made in the application. The City Planner shall
forward such information to the Commission with his recommendation.
Amend SECTION 10-C.2.2. to read:
The applicant shall give public notice by publication in a local newspaper of
general circulation at least (15) fifteen days prior to a date set for a public
hearing before the Commission. The City Planner shall notify all property owners
of recrod within two hundred (200) feet of the property in question at least ten
(10) days prior to the date set for the public hearing by certified letter. The
City Planner shall also give a report and recommendation to the Commission on the
date of the hearing.
Add to SECTION 13-A.6.1. the following:
Publication of said notice shall be the responsibility of the applicant.
Amend SECTION 13-A.6.2. to read:
Notice of the proposed zoning change shall also be made by the City Planner by
mailing notification by certified letter to the person or firm to whom the property
is assessed, and to all persons or firms to whom property within two hundred (200)
feet of the proposed zoning change is assessed on the City tax rolls.
Amend SECTION 13-B.1. to read:
All applications for amendments to this ordinance shall be signed and filed with the
City Planner. Such application shall be accompanied by a check made payable to the
City of College Station in the amount of $25.00 plus $2.00 per person or firm within
two hundred (200) feet of the property defined in the application. Said filing
fee shall not be refundable. If due to the action of the applicant, the hearing
