AN ORDINANCE REZONING A 1.00 ACRE TRACT IN THE D. A. SMITH SUBDIVISION IN THE RICHARD
_ CARTER LEAGUE MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE FROM APARTMENT
BUILDING DISTRICT R-3 TO GENERAL COMMERCIAL DISTRICT C-1.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS:
WHEREAS, the City Council held a public hearing in the City Hall at 7:00 P.M. on
Thursday, January 8, 1976 on the question of rezoning certain areas within the city
limits;
AND, WHEREAS, the City Council has determined the following:
To rezone or change the classification of all that certain tract of land in the D. A.
Smith Subdivision in the Richard Carter League conveyed in deeds recorded in Volume
189, Page 353 and Volume 286, Page 588 of the Brazos County Deed Records and shown
on a plat recorded in Volume 49, Page 106 of the Deed Records of Brazos County,
Texas, and being particularly described as follows:
BEGINNING at the west corner of Lot 21 in D. A. Smith Subdivision, City of College
Station, Brazos County, Texas, which is also the south corner of Lot G of College
Heights Subdivision, City of College Station;
THENCE: N 45 E along the dividing line between Lot G of College Heights Subdivision
and Lot 21 of D. A. Smith Subdivision, to N corner of Lot 21;
THENCE: S 45 E a distance of 220' along the dividing line of Lots 21 and 22 to the
North corner of a tract of land conveyed to Lillie Bary by Viola Bryant, et vir,
by deed dated July 27, 1935, and recorded in Volume 89, Page 502, Record of Deeds of
f Brazos County, Texas, same being the S.E. one half of tract 21 in Subdivision.
THENCE: S 45 W a distance 198.0' to stake on N.E. line of Turner Street;
THENCE: N 45 W 220' to PLACE OF BEGINNING and containing 1.00 acre more or less,
from Apartment Building District R-3 to General Commercial District C-1.
And, it is ordained that said change be effective immediately.
