HomeMy WebLinkAbout1975-0955 - Ordinance - 03/03/1975n M ORDINANCE NO. 955 AN ORDINANCE AMENDING ORDINANCE NO. 608, SAID ORDINANCE KNOWN AS AN ORDINANCE REGULATING, CONTROLLING, AND GOVERNING THE DEVELOPMENT OF STREETS, PRESCRIBING REQUIREMENTS, ESTABLISHING PARKING AND SIDEWALK REQUIREMENTS, AND ESTABLISHING A MASTER PLAN OF PRINCIPAL STREETS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: WHEREAS, it has come to the attention of the City Countil of the City of College Station, Texas that Section 5,6,8 and 9 of Ordinance No. 608 are obsolete with respect to current costs and conditions within the city. THEREFORE, it is ordered and ordained that Sections 5,6,8 and 9 of Ordinance No. 608, be amended to read as follows: SECTION 5. PRIORITY IN STREET CONSTRUCTION In the established and platted part of the city, priority in street construction will be established by the City Council, based on recommendations of the City Manager and the City Engineer. Lenghths shall be one block or more, considering drainage and availability of funds. Priority will be given petitions submitted by property owners representing a percentage of the front footage of the property on both sides of the street as established by policy of the City Council. The City Council may, however, at its discretion, when a situation warrants, arrange for the construction of certain streets, or parts of such, without a petition. SECTION 6. ASSESSMENT FOR STREET CONSTRUCTION In the established and platted part of the city, the paving cost to the adjacent property owner shall be established by policy of the City Council. For new subdivisions, see "Subdivision Regulations." SECTION 8. PRIORITY IN SIDEWALK CONSTRUCTION In the established and platted part of the city, priority in sidewalk construction will be established by the City Council, based on recommendations of the City Manager and the City Engineer. Lengths shall be one block or more. First consideration will be given to major streets, second consideration to minor streets; however, no consideration will be given until petitioned by property owners representing a percentage of the front footage of the property as established by policy of the City Council, and funds are available. The Council may, however, at its discretion, when a situation warrants, arrange for construction without a signed petition. SECTION 9. ASSESSMENT FOR SIDEWALK CONSTRUCTION In the established and platted part of the city, the assessment to the property owner for the standard four foot sidewalk construction shall be established by policy of the City Council. 02542 ORDINANCE NO. 955 Page 2 In new subdivisions, see "Subdivision Regulations". The fact that Ordinance No. 901 is obsolete with respect to Section 3, paragraph I creates an emergency and urgent public necessity and this ordinance is hereby finally passed as an emergency ordinance on the date of its introduction.
