ORDINANCE NO. 942
AN ORDINANCE AUTHORIZING THE EMPLOYMENT OF THE LAW FIRM OF
SEARS AND BURNS TO REPRESENT CERTAIN DEFENDANTS, PAST AND
PRESENT OFFICERS AND EMPLOYEES OF THE CITY IN SUIT FENDING
IN FEDERAL COURT; APPROVING FORM OF CONTRACT BETWEEN CITY
AND SUCH LAW FIRM; MAKING CERTAIN FINDINGS WITH RESPECT
THERETO; AND PROVIDING AN IMMEDIATE EFFECTIVE DATE.

WHEREAS, on August 30, 1974, the City Council of the
City of College Station adopted a motion recognizing the City
of College Station's obligation, duty and policy with respect
to the defense of City officers and employees, past and present,
who have been sued in Civil Action No. 74-H-1071 in United States
District Court for the Southern District of Texas, Houston
Division, in the case styled: "RALPH R. BOBBITT v. L. P.
DULANEY, ET AL", wherein six present and six former officers
and employees of the City of College Station have been sued
as Defendants because of acts allegedly growing out of the
duties of their employment in the enforcement of the ordi-
nances of the City of College Station (which motion is manifest
in the Minutes of the City Council and which is incorporated
by reference herein for all purposes), and,
WHEREAS, the law firm of Sears and Burns of Houston,
Texas, has, in response to such motion and at the special
instance and request of the City of College Station, undertaken
the defense of such employees on the terms hereinafter set
forth; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION:
Section 1. That the law firm of Sears and Burns of Houston,
Texas be and such firm is hereby employed by the City of College

Station to represent any and all defendants in the suit above
described who desire the services of such firm, and who are
either present or past officers or employees of the City of
College Station.
Section 2. The City Council hereby approves the Contract
of Employment between the City of College Station and the
law firm of Sears and Burns, approved by the City Attorney,
which Contract has been exhibited to Council prior to the
passage of this ordinance, and hereby authorizes the City
Manager to execute such Contract for and on behalf of the
City of College Station.
Section 3. The CityCouncil finds that all provisions of the
Open MeetingsLaw of the State df Texas have been complied
with, prior to the passage hereof; and that proper appropria-
tion of current funds to cover the City's obligations hereunder
exists and has been made.
Section 4. This Ordinance shall take effect and be in force
immediately upon its passage.
