ZONING BOARD OF ADJUSTMENT
September 14, 1976

Agenda Item No 1 -- Approval of the minutes of the meeting of
Au~tzst 10 , 1976 .
Hughey moved that the minutes be approved as read. The motion was
seconded by Runnels and unanimously approved.
effenda Item No. 2 -- The Board agreed to defer this item.
Agenda Item No 3 -- Consideration of a request for variance from
W.E. Crenshaw at 614 Banks Street.
Building Official Koehler explained the nature of the request.
Mr. Van Thompson stated that in his opinion the lot was too small
and the placement of the house to be constructed was not out of
keeping with the present housing in the area. Mrs. Greer said that
she would prefer that the neighborhood stay like it was. Nh~. Hughey
pointed out that the single family residence was the least restrictive
use allowed in any zone in College Station. Mrs. Storts pointed out
that the city could not require the land to stay vacant. Hughey
moved that the variance in regard to the minimum lot depth be granted
for the house but that no variance be granted to the setback provisions
for the garage. The motion was seconded by Storts and unanimously
approved.
Q~enda Item No. 2 -- Consideration of a request for variance from
Charles E. Whitaker at 1006 Rose Circle.
Koehler explained the nature of the request and pointed out that
there had been some confusion concerning the issuance of the permit.
Mr. Whitaker explained that he had been unaware of the difference
between a receipt for permit fees and the actual building permit
itself, and that he had not been cognizant of the exact location of
the property line or the requirement for a 72 foot setback or the
requirement of a slab steel inspection before the pour. Mr. Jim
Luscombe, the adjoining neighbor, stated that he would agree to
refrain from building anything on his property within 15 ft, and
encouraged the board to allow the applicant to finish the building he
has started. Koehler stated that he could see no physical problem for
the city with the building completed as it had been started near the
property line.
Chairman Weiss pointed out that one of the issues to be considered
by the Board was that of the characteristics of the neighborhood
and whether or not the Board would accomplish the ends of the
ordinance by granting the variance. Mr. Whitaker stated that he
would be able to offset the building by 72 ft, on the slab but that
this would penalize the remainder of the neighborhood by the unsightly
appearance of the concrete slab protruding from the building. Hughey
moved that the variance be granted to allow the building to be completed
as the slab was now situated. The motion was seconded by Runnels and
unanimously approved.
Agenda Item No. 4 -- Other Business
The Board considered the procedures for issuing remodeling permits and
reviewed the materials that are given or presented to the permit
applicant at the time the permit is applied for. The Board suggested
that the following steps be taken to prevent this type of misunderstanding
in the future:
1. Make clear to a homeowner's permit applicant the difference between
a receipt for fees and a building permit.
2. Question the applicant for homeowner's permit to be certain that
he is familiar with the rules and ordinances which would be the
most likely source of confusion and misunderstanding.
3. Generate a packet or a sheet of information for a homeowner's
permit applicant which would explain the most commonly
misunderstood or violated requirements of ordinances regulating
construction.

Ringer moved that the meeting be adjourned. The motion was
seconded by Weiss and unanimously approved.;
