MEMBERS PRESENT: Chairman Birdwell, Members Rife, Poston, Hollas and Sawtelle.
MEMBERS ABSENT: Alternate Members Alexander, Ochoa and Blackwelder.
STAFF PRESENT: Staff Planner Dunn, Planning Technician Thomas and Assistant City
Attorney Shively.
AGENDA ITEM NO. 1: Call to order -explanation of functions of the Board.
Chairman Birdwell called the meeting to order and explained the functions and limitations of the
Board.
AGENDA ITEM NO. 2: Approval of minutes from the meeting of July 18, 1995.
• Mr. Hollas moved to approve the minutes from the meeting of July 18, 1995 as written. Ms.
Poston seconded the motion which passed unopposed (4 - 0). Mr. Rife was not present during
the approval of minutes.
AGENDA ITEM N0.3: Consideration of a variance request to the sign ordinance to allow
two freestanding signs along Central Park Lane for the Windsor Pointe Apartments
currently under construction at 800 Southwest Parkway.
Staff Planner Dunn presented the staff report and informed the Board that the applicant is
requesting two apartment identification signs for a new apartment complex. The applicant feels
that the extension of a public street, Central Park Lane, is a special condition not generally found
within the City which divides the project into two separate areas. The applicant also feels that
placing signage for one area and not the other would be a hardship in that it would confuse the
public as to the identity of the project. On December 4, 1990, the Board granted more than one
apartment identification sign for Treehouse apartments. An existing sign was located at the
entrance to Marion Pugh Drive. The variance allowed a second identification sign to be located
at the project's south entrance to Holleman Drive. Two surrounding property owners were
notified of the public hearing with no response.
Chairman Birdwell opened the public hearing.

Engineering representative of the applicant, Greg Taggart of the Municipal Development Group,
approached the Board and was sworn in by Chairman Birdwell. He stated that the owner
purchased the property to develop one apartment complex and then had to separate the
development in order to construct Central Park Lane. Mr. Taggart informed the Board that two
signs for a sixteen acre development is reasonable and if the variance is granted, the signs will still
meet the intent of the ordinance. He stated that the signs have not been designed pending the
variance request.
Chairman Birdwell closed the public hearing.

Mr. Sawtelle stated that he understands how the road splitting the development would cause
confusion for motorists looking for the complex. He suggested that the owner place the address
or some other designation on the two proposed signs to clearly identify what units are on the two
different sides.
Chairman Birdwell stated that if the two sides were developed separately or even named
differently, two signs would be allowed.
Mr. Sawtelle moved to authorize a variance to the sign regulations from section 12, ordinance
number 1638 as it will not be contrary to the public interest due to the following unique special
conditions not generally found within the City: a newly developed roadway which bisects the
property; and because a strict enforcement of the provisions of the ordinance would result in
substantial hardship to this applicant being: confusion to the public in accessing the units within
the complex; and such that the spirit and intent of this ordinance shall be preserved and the
general interests of the public and applicant served, subject to the following limitations: that the
signs clearly indicate which units are located on each side of the road. Mr. Rife seconded the
motion which passed unopposed (5 - 0).

Mr. Sawtelle moved to adjourn the meeting of the Zoning Board of Adjustment. Chairman
Birdwell seconded the motion which passed unopposed (5 - 0).
