Zoning Board of Adjustment

AGENDA ITEM NO. 1: Call to order -explanation of functions of the Board.
Chairman Birdwell called the meeting to order and explained the functions and limitations of the
Board.
AGENDA ITEM NO. 2: Approval of minutes from the meeting of June 1, 1993.
• Mr. Sawtelle moved to approve the minutes from the meeting of June 1, 1993 as written. Mr. Rife
seconded the motion which passed unopposed (4 - 0).
AGENDA ITEM NO. 3: Consideration of a variance request by Cornerstone Construction to the
rear setback requirements to allow for an addition to the home located at 621 Columbus.
Staff Planner Kuenzel presented the staff report to allow for an addition to the home at 621
Columbus. The applicant is proposing a rear setback of 15' and a side street setback of 8'. The
subdivision is one of the oldest in College Station. Many homes in the area are old and predate
current setback restrictions; therefore, many of the buildings in this area are nonconforming. The
buildable portion on a minimum R-1 lot is 1750 square feet. On these lots, however, the buildable
portion is reduced to 962 square feet because there is an additional 7.5' of setback that must be met
on the side street, and because the lot does not meet minimum R-1 restrictions. Subdivisions that
have been platted in more recent years have larger corner lots to accommodate the increased
setback requirements. This variance would allow a total building area of 1425 square feet to the
buildable area on each lot. The City's Community Development Department has been doing
remodeling work in this neighborhood. All such programs contain special clauses that make
exceptions for setback problems. This project is not a part of that program and must go through
the variance process. On November 3, 1993, the Board granted side street setback variances for the
lots located at 519, 601 and 607 Chappel and for 609 Columbus. Twenty-three surrounding property
owners were notified with one response in favor of the proposed variance request.
Chairman Birdwell opened the public hearing
Applicant David Vanadore of Cornerstone Construction approached the Board and was sworn in by
Chairman Birdwell. He informed the Board that the family needs more living space in general and
an additional bath room. The proposed renovation of the subject home would enhance the
surrounding neighborhood.
Chairman Birdwell closed the public hearing. He stated that the subject property is smaller than
most modern corner residential lots. The right-of-way along Tarrow Street is extremely wide and it
is unlikely that Tarrow Street will be expanded to the total right-of-way width.
Mr. Rife explained that there are unusual circumstances in this case since the final plat of the area
pre-dates current ordinance requirements.

Mr. DeOtte stated that the extreme right-of-way along Tarrow Street meets the ordinance intent in
that it provides adequate light and air.
Mr. Sawtelle moved to authorize a variance from Section 15, Ordinance Number 1638 to the
minimum setback requirements from the terms of this ordinance as it will not be contrary to the
public interest due to the following special conditions: unusually small size of the lot and the right-
of-way between curb and lot line along Tarrow being 27', counteracts the concerns for space and
light addressed by minimum setback requirements; and because a strict enforcement of the
provisions of the ordinance would result in unnecessary hardship to this applicant being: the inability
to enhance the livability of the structure; and such that the spirit of this ordinance shall be observed
and substantial justice done subject to the following limitations: that the rear setback will not be less
than 15' and the side street setback will not be less than 8'. Mr. DeOtte seconded the motion which
passed unopposed (4 - 0).

Mr. DeOtte moved to adjourn the meeting of the Zoning Board of Adjustment. Mr. Rife seconded
the motion which passed unopposed (4 - 0).
