Zoning Board of Adjustment
May 1, 1990

MEMBERS PRESENT: Chairman Ruesink, Members Henry, Baker,
and Alternate Member Phinney
MEMBERS ABSENT: Vice Chairman Gilmore, Member Cronan,
and Alternate Members Webb, Gaston, and
Kennady.
STAFF PRESENT: Planning Assistant Kuenzel, Assistant
City Attorney Banks, Development
Coordinator Volk, and Planning
Technician Rosier
Chairman Ruesink called the meeting to order and explained
the functions and limitations of the Board.
AGENDA ITEM N0. 1: Call to Order - explanation of functions
and limitations of the Board.
AGENDA ITEM NO. 2: Approval of minutes - meeting of April
17, 1990.
Mr. Henry made a motion to approve the minutes as submitted.
Mr. Phinney seconded the motion which carried unanimously.

AGENDA ITEM N0. 3: Consideration of a request for a
variance to the rear setback regulations at Lot 8 Block 61
Southwood Valley Section 24 C (712 Encinas Place).
Applicant is Thomas Properties.
Assistant Planner Kuenzel presented the staff report
accompanied by slides of the subject area. She stated that
a 30' utility easement exists behind the subject property.
Kuenzel pointed out the uniqueness of the street
configuration which scoops toward the lot much like a cul-
de-sac curve.
Kuenzel then defined the buildable area as outlined on a
slide.
She stated that this request is proposing to encroach the
minimum rear setback requirements. She. also pointed out
that the house would fit on other lots. She said that the
house is smaller than most of the others built in this area.
Kuenzel concluded her presentation by saying that we have
received no responses in regard to this request.
Mr. Henry asked if there were other houses built on Encinas
or if the lots were vacant.
Kuenzel said she believed that most of the lots contain
houses.
Charles Thomas of 2902 Coronado Dr. came forward and was
sworn in. He stated that he agrees with the information
presented in the staff report. He also said that this same
home currently exists at 3008 Bolero. He said it is a nice
home which would only improve the property value in the
area.
Glen Thomas of 3010 Brothers Blvd came forward and was sworn
in. He stated that this is one of the last lots to be
developed because of its difficulty. He added that the same
house on Bolero will be featured in an upcoming parade of
homes. He mentioned that an A&M cou le "

this house and they want a wooded lot. He said that they
were not interested in the "sunshine" lots on Aztec.
He said that he believes that the property behind the
subject lot is unlikely to be developed soon. However, he
pointed out that the 20 foot rear setback plus the 30 foot
easement, totals at least a 50 foot separation from future
development.
Development Coordinator Volk cautioned that the City has no
control in regard to development of property past the City
limits which abuts the utility easement.
Mr. Henry asked about the future extension of Welsh Avenue
to find out if the location of the utility easement is
likely to change.
Assistant City Attorney Banks said she believes this is
unlikely due to the cost that would be incurred by the
developer.

Volk pointed out that the area being discussed is not a
parcel belonging to Area Progress.
Glen Thomas explained the City's drainage system from Rock
Prairie to Durango. He believed that the current drainage
path is the natural flow which would be difficult to re-
route.
Mr. Henry asked if the subject "Lot 8" is in the same
predicament as Lot 19 at the other end of Encinas.
Ms. Kuenzel said that it is vacant but, she had just signed
a building permit for Lot 19.

AGENDA ITEM NO. 4: Other Business.
Assistant City Attorney Banks announced that this was her
last meeting with the Board. She also said that the Board
will have a meeting on the 15th of May to hear Weed Appeals.
AGENDA ITEM NO. 5: Adjourn.
Mr. Henry made a motion to adjourn. Ms. Baker seconded the
motion and the meeting was adjourned.
