HomeMy WebLinkAbout2006-2922 - Ordinance - 08/24/2006 ORDINANCE NO. 2922 AN ORDINANCE AMENDING CHAPTER 12, "UNIFIED DEVELOPMENT ORDINANCE," SECTION 4.2, "OFFICIAL ZONING MAP," OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY CHANGING THE ZONING DISTRICT BOUNDARIES AFFECTING CERTAIN PROPERTIES AS DESCRIBED BELOW; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART I: That Chapter 12, "Unified Development Ordinance," Section 4.2, "Official Zoning Map," of the Code of Ordinances of the City of College Station, Texas, be amended as set out in Exhibit "A", attached hereto and made a part of this ordinance for all purposes. PART 2: That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than Two Thousand Dollars ($2,000.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance, being a penal ordinance, becomes effective ten (10) days after its date of passage by the City Council, as provided by Section 35 of the Charter of the City of College Station. RON A, Mayor - Com1ie Hooks, City Secretary APPROVED: ~f1i4 :<<'~4~ ORDINANCE NO. 2922 Page 2 EXHIBIT "A" That Chapter 12, "Unified Development Ordinance," Section 4.2, "Official Zoning Map," of the Code of Ordinances ofthe City of College Station, Texas, is hereby amended as follows: Tract I The following property is rezoned from C-3 Light Commercial to PDD Planned Development District: The south 135 feet of Lot 1, Block A of the Haney Highway 6 Subdivision along Texas Avenue (the property graphically shown in Exhibit "B" and the location more generally shown in Exhibit "C"). Purpose Statement: This PDD is to allow for the redevelopment of this tract of land while protecting the integrity of the Mile Drive neighborhood. Uses requested are those commercial uses typically found at points of highest visibility and highest traffic counts such as this location. At the same time impacts to the Mile Drive neighborhood will be mitigated by precluding certain more intense uses normally allowed in the C-3 and C-l zoning districts. The lot will contain two different PDD districts such that the most intense use, the drive-thru restaurant facility, will be located only on the most southerly portion of the property. All other minimum standards will be met with a concept plan developed in accordance with Design Review Board considerations. The following uses are approved with this PDD zoning district: Animal Care Facilities - Indoor Art Studio Gallery Educational Facility - Indoor Instruction Mini-Storage Warehouse with Accessory Living Quarters Maximum two-story building with office and / or other uses permitted herein Clinic / Medical Office Personal Service Shop Printing / Copy Shop Radio / TV Station / Studio Retail Sales and Service Financial Institution with Drive-thru One Restaurant with a Drive-thru Tract II The following property is rezoned from C-3 Light Commercial to PDD Planned Development District: ORDINANCE NO. 2922 Page 3 Lot 1, Block A of the Haney Highway 6 Subdivision save and except the south 135 feet along Texas Avenue (the property graphically shown in Exhibit "B" and the location more generally shown in Exhibit "e").
