Empresario Austin for the contract of June 4, 1825, in your presence with the greatest prespect make known: That my station is that of a married man, that, with my family, I have entered this country for the purpose of acquiring lands for my permanent settle - ment; wich which understanding and with previous approval of same Hon. Em- presario, I have selected a league of land which is situated east of the Bra- zos River, adjoining and southwest of the league of land conceted to Richard Carter, and known as League No. 6 North q� Nav�anta Crusaik. — parduhish reason, I present myself to you in order that you may be pleased to admit me and put me in possession of said league, it being under- stood that I offer to comply with the pro- visions of the law in the matter. I P 1T'114111 September 4, 1827, which govern me, n nd :ith additional article dated the 25th of April, 1830, and in thc name of the State, 1 concede to, confer upon and put thc said Joseph E. Scott in real and personal possdssion of one league of land; which land has been surveyed by Surveyor Horacio Chricsman, previously appoint ed for the purpose, under the following situation and boundaries; Situated East of the Brazos River and North of Navasota Creek and, according to the plan, numbered 6 and adjoining the leagues belonging to Richard Carter, Crawford Burnet and Zeno Phillips. And beginning the Survey at the west corner of said Burnet's league at a stake; from which x white oak 18 inches in diameter bears South 55 East 5 varas distant and another 15 inches in dia- meter bears South 74 West 8 tares distant; a line was run North 45 ;1est..5000 varas to the South corner of Zeno Phillip's league at a stoke;' ,from - yrhich a white oak 9 varas distant bears South 21i West and another 15 va'ra's-distant bears North 18 'Jest. Thence North 45 East and following the southeast boundary line ...of said Phillip's league 5000 varas to the west corner of Richard Carter's league. Thence South 45 East and following the southwest boun- dary line of Carter's said league 5000 varas to the south corner of same league which is also the north corner of said League No. 3 where there is a stake; from which a black jack 18 vo ra s dis- tant bears North 47 ,'Jest and a red oak 12 wares distant bears South 72 East. Thence South 45 :;pest 5000 varas and following the boundary line of said League No. 3 of Crawford Burnet's to the place of beginning, and comprising an area of one league of land. Three labors of said land belong to the class of arable and twenty -two labors to .tilt.at 'of pasture land. Which serves as a classification for the price he must pay to the State for it ,if accordance with Article 22 of said law, under the penalties' therein established; he being reminded that with- in one year, he must erect permanent landmarks at every angle of the land and that he must settle and cultivate it in cam- foxmitory with the provisions of the law. Therefore, exercising the power conceded to me by said law and consequent instructions, I issue the pres.nt in- strument and order that testimonio be taken of it end be deliver- ed to the interested party SD that he may possess and enjoy the benefit of the land, he, his children, heirs and successors or whoever, from him or from them, may have cease or right. On the eleventh day of I:icy, cne thousand eight hundred and thirty five, before yo, George Erring, Primary Judge of the Juris- diction of Austin end the instrumental witnesses named:. hereafter end my assistants with whom I authenticate for wont of a Notary appeared the citizen, Joseph E. Scott, whom I know end: to whose acts I give, full faith and creclit,who declared that he hcs this day for and in consideration of the sum of seventeen hundred dollars to him in hand paid, the receipt of which he acknowledges and with which he expresses himself, satisfied and contented has bargained, sold and delivered unto the citizen Moseley Baker, one half of the league of land No. 6,lying in Austins Colony east of the river Brazos and North of the Navasota R.iver,granted to •the said Sot by Miguel Arciniega the Commissioner of the State of Coahuila and Texas, on the twentysecond day of November, One thousand eight hundred Lnd thirty two, which said half league of lend thus sold to the said Bolter is bounded as follows; Commencing at the Northeast corner of League No. 6, (a), as marked on the plat here attached; THENCE West five thousand varas to the northwest corner (b) THENCE South two thousand five hundred varas being midway of the west line of said league (x) on the plat; mini East to the Eastern line of said league (D) on the plat; being five thousand varas; THENCE North two thousand. five hundred varas to the Northeast corner of said league; being the point beginnirg (Al on the plot ; the same being the North half of said league of land, Containing two thousand two hundred and twenty two acres of land. And the said Scott declares that the said land belongs to ' him in possession and property, that he has not sold; alienated; leased or Mortgaged it: that it is free of all encumbracnes whatsoever; and as such he sells it to the said Moseley Baker; for the before described sum of money and he renounces the laws "Non Numerata Pecunia° "No Etrega and Prueba" and he also de- clares that the price paid is the just and full value of said land; and if it be worth throe or the excess, be the same much or little he makes a free and irrevocable donation of the same to the said Baker. He; the said Scott binds himself to make good this title and sale and to the observance of all the above he binds his person and property both present and future and with them submits himself to the jurisdiction of tri- bunals competent to take cognizance of this business, in order that they may compel him to perform the same under all the rigors of the law. He renounces all laws that might favor him as well as that which prohibits this general renunciation, All this he de- clared and signed with me; the instrumental witnesses being Horatio Chrisnan and Spencer H. V. Preston, wife of T. J. Preston, or order, on or before October Sth, 1912, and October 5th, 1913, respectively; AND WHEREAS, afterwards by deed dated the - -- day of October, 1913, and reoorded in the Deed Records of Brazos County, Texas, in Volume 42, page 652, said Joseph Hrdlioka conveyed to Ed Hrdlioka of Brazos County, Texas, an undivided one -third (1/3) interest in oertain lands specified in said deed; and whereas, in said deed the said Ed Hrdlioka as part of the oon- sideration therefore, assumed the payment of the said two (2) notes above mentioned, and a vendor's lien was retained in said deed to secure payment of said notes, reference being here made to said deed and deed of trust and their said records for further description of said lands and notes; AND WHEREAS, since the execution and delivery of said notes and deed of trust, the said Mrs. V. V. Preston has died, leaving a will which has been duly probated in the County Court of Freestone County, Texas, where she resides at the time of her death; and whereas, said T. J. Preston, 'he surviving hus- band of said Mrs. V. V. Preston is the sole beneficiary under said will and by virture of same beoame the sole and legal owner of both of said notes above mentioned. And whereas, the said Ed Hrdlioka has paid to said T. J. Preston the first of said notes, to -wit: said note for the sum of Six Hundred Dollars ($600.00) payable on or before October 5th, 1912; NOW, THEREFORE, I, the said T. J. Preston formerly of Brazos County, Texas, but now of Freestone County, Texas, but now of Freestone County Texas, being the legal owner alai holder or said note at the t ime of its said payment, do hereby acknowledge the full and final payment of said note so paid to me, as aforesaid, and do hereby release said lands from both of said liens above mentioned so far as they or either of them apply to said note so paid to me, but no further; it being specially understood and stipulated that this is but a partial release and applies only to said note so paid to me as aforesaid, and that said deed of trust and the lien thereby oreated, and said vendor's lien shall be and remain in full force and effect as to and on all the lands embraced in sa (except the 67 -acre traot heretofore released by me by released dated October 14th, 1915, and recorded in the Release Records of Brazos' County, Texas, in Volume 6, page 319 until the other one of said notes, to -wit, said note for the said sum of Six Hundred Dollars ($600.00) payable on or before October 5th, 1913, (and Whioh is still unpaid) shall be tally paid, together with all interest thereon, according to the tenor and effect of said note, and know all men by these presents, that I, the said T. J. Preston, being the legal owner and holder of said last mentioned note, to -wit, said note for the sum of Six Hundred Dollars ($600.00) payable on or before October 5th, 1913, for full value received, have this day endorsed, transferred, said liens securing same to the First State Bank & Trust Company of Bryan, a corporation of Brazos County, Texas, without recourse on me, and for said oonsideration I also transfer, assign and oonvey unto the said First State Bank & Trust Company of Bryan, the said deed of trust and the lien thereby oreated, and said vendor's lien, and all other seourities of any and every kind owned or held by me as security for the payment of said note; and I also hereby assign and oonvey to said First State Bank & Trust Company of Bryan, all the right, title, claim and interest of any every kind which I may have or own, or in anywise be entitled to, in and to said lands and every part thereof, by virture of said deed of trust and deed and said notes; TO HAVE AND TO HOLD the same unto the said First State Bank & Trust Company of Bryan, its successors and assigns forever. 1916.
