HomeMy WebLinkAbout2005-2793 - Ordinance - 03/22/2005 ORDINANCE NO. 2793 AN ORDINANCE AMENDING CHAPTER 4, "BUSINESS REGULATIONS", OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS, BY AMENDING CERTAIN SECTIONS AS SET OUT BELOW; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS; PART 1: PART 2: PART 3: That Chapter 4, "Business Regulations", of the Code of Ordinances of the City of College Station, Texas, be as set out in Exhibit "A," attached hereto and made part of this ordinance for all practical purposes. That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than Five Hundred Dollars ($500.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. Said Ordinance shall become effective on October 1, 2005. RON SIL , Mayor b{TES"J': ". n liH~ +hlrL Connie Hooks, City Secretary APPROVED: Ci~~~ ORDINANCE NO. 2793 Page 2 EXHIBIT "A" That Chapter 4, "Business Regulations", of the Code of Ordinances of the City of College Station, is hereby amended by adding Section 19, "RENTAL REGISTRATION OF SINGLE FAMILY AND DUPLEX RENTAL UNITS", as set out hereafter to read as follows: "SECTION 19: A. RENTAL REGISTRATION OF SINGLE F AMIL Y AND DUPLEX RENTAL UNITS DEFINITIONS (1) (2) (3) (4) B. Rental Propertv:-Any property that is not owner occupied regardless if rent is charged. Duplex: - Any property that is designed to serve as two independent living units. Single Familv: - A property that is designed to serve as one independent living unit. Owner Occupied: - Any rental property that is inhabited by the owner, son, daughter or spouse. REGULATIONS (1) c. Each owner and real estate manager of single family and duplex residential property that serves as rental property shall be required to annually register the property with the City of College Station Fire Department Community Enhancement Division. The information required to register the property is as follows: (a) (b) (c) (d) Address of the rental property. Owner and contact information for the owner. Type of property such as single family or duplex. Local contact person with contact information. In the case of an absentee owner. Local contact must reside within a thirty (30) minute drive time of the College Station City limits. EXCEPTION A property owner that resides on the property may have one (1) renter and is not required to register as having rental property. The property is subject to the limitations of unrelated individuals as living on the property as provided in the definition offamily in the Unified Development Ordinance. ORDINANCE NO. 2793 Page 3 D. There shall be an initial rental registration fee of Twenty-five Dollars ($25.00) for each single family or duplex property that is registered and Fifteen Dollars ($15.00) for each subsequent year."
