HomeMy WebLinkAbout1996-2189 - Ordinance - 07/11/1996ORDINANCE NO. 2189 AN ORDINANCE REZONING A 48.24 ACRE TRACT OF LAND SITUATED IN THE THOMAS CARUTHERS LEAGUE, ABSTRACT NO. 9, IN THE CITY OF COLLEGE STATION, BRAZOS COUNTY, TEXAS, A PORTION OF THE JERRY WINDHAM AND FRANK THURMOND 112.19 ACRE TRACT (571/144), FROM A-O AGRICULTURAL OPEN TO R-1 SINGLE FAMILY RESIDENTIAL. WHEREAS, on July 11, 1996, the City Council of the City of College Station convened and, pursuant to notices prescribed by law, held a public hearing with regard to the application for the rezoning of 48.24 acres of property situated in the Thomas Caruthers League, Abstract No. 9, in the City of College Station, Brazos County, Texas, and more particularly described as follows: BEING ALL OF THAT CERTAIN TRACT OR PARCEL OF LAND CONTAINING 48.24 ACRES OF LAND OUT OF AND A PART OF THE REMAINDER OF A CALLED 112.19 ACRE TRACT OF LAND IN THE THOMAS CARUTHERS LEAGUE, A-9, SAID CALLED 112.19 ACRE TRACT OF LAND BEING CONVEYED FROM HOO-PANG NGIAM, ET UX., SHAU-KING CHU NGIAM, TO JERRY WINDHAM AND FRANK THURMOND BY DEED RECORDED IN VOLUME 571, PAGE 144 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS (D.R.B.C.T.); SAID TRACT OF LAND CONTAINING 48.24 ACRES OF LAND BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING at a fence comer found for most southerly comer at the most southerly comer of said remainder of the called 112.19 acre tract of land and the most easterly comer of the remainder of the Marsh-Reeves Estate called 16.6 acre tract of land as described in Volume 509, Page 188, D.R.B.C.T., said fence comer being in the northwest right-of-way line of Greens Prairie Road; THENCE, N 45°34'28" W, along the southwest line of said remainder of the called 112.19 acre tract of land and the northeast line of said remainder of the called 16.6 acre Marsh-Reeves Estate tract of land, a distance of 2267.90 feet to a 3" round wood post fence corner found for most westerly comer at an exterior ell comer of said remainder of the called 112.19 a~,re tract of land and the most southerly comer of a called 10.01 acre tract of land conveyed to M. V. Creagor by deed of record in Volume 1849, Page 317 of the Official Records of Brazos County, Texas (O.R.B.C.T.); THENCE, N 44°59'33'' E, along the southeast line of said M. V. Creagor called 10.01 acre tract of land and a west line of said remainder of the called 112.19 acre tract of land, a distance of 336.46 feet to 1/2" iron rod set for most northerly northeast,comer at an interior ell comer of said remainder of the called 112.19 acre tract of land and the most easterly comer of said called 10.01 acre Creagor tract of land; THENCE, through the interior of said remainder of the called 112.19 acre tract of land, the following courses: 1.) S 44°35'01" E, a distance of 183.13 feet to a 1/2" iron rod set in the centerline of a creek; 2.) along said creek, S 87°14'40" E, a distance of 78.61 feet to a point for angle; 3.) along said creek, S 71°47'01" E, a distance of 186.98 feet to a point for angle; 4.) along said creek, N 74°39'59" E, a distance of 82.24 feet to a point for angle; 5.) along said creek, N 35°37'28" E, a distance of 242.37 feet to a point for angle; 6.) along said creek, S 86°27'51.. E, a distance of 100.70 feet to a point for angle; nt/o/ord10 7.do~ 6/~ ! /~6 Ordinance No. 2189 Page 2 7.) along said creek, S 62*04'40" E, a distance of 89.46 feet to a point for angle; 8.) along said creek, N 77'37'19" E, a distance of 106.01 feet to a point for angle; and, 9.) along said creek, N 06'22'51" E, a distance of 158.38 feet to a point for most eastedy northeast comer in the northeast line of said remainder of the called 112.19 acre tract of land and the southwest line of a called 139.99 acre tract of land conveyed to M. V. Creagor by deed of record in Volume 1849, Page 308 O.R.B.C.T.; THENCE, S 44'55'10" E, leaving said centerline of the creek and with said northeast line of the remainder of the called 112.19 acre tract of land and said southwest line of the called 139.99 acre Creagor tract of land, a distance of 1740.24 feet to a fence comer found for most eastedy comer at the most eastedy corner of said remainder of the called 112.19 acre tract of land and the most southerly corner of said called 139.99 acre Creagor tract of land, same being a point in the aforesaid northwest right-of-way line of Greens Praide Road; THENCE, S 45*03'42" W, with said northwest right-of-way line of Greens Praide Road and the southeast line of said remainder of the called 112.19 acre tract of land, a distance of 1063.61 feet to the POINT OF BEGINNING, and containing 48.24 acres of land, more or less, according to a survey performed on the ground in March, 1996 under the supervision of Donald D. Gan'eft, Registered Professional Land Surveyor No. 2972. WHEREAS, the above-described property is currently zoned A-O Agricultural Open, and the current use is agricultural; WHEREAS, the owners of the above-described property, Jerry Windham and Frank Thurmond, purchased the property on April 14, 1983, by deed recorded in Volume 571, Page 144 of the Official Records of Brazos County, Texas; WHEREAS, the owners have applied for the rezoning of the above-described property to R-1 Single Family Residential; WHEREAS, the City Council of the City of College Station heard evidence that the area in which the above described tract is located is currently used for agriculture; WHEREAS, rezoning the subject tract of land into the aforementioned tract would allow the owner to develop the property in such a way that it fills a need in the local real property market; and WHEREAS, the subject rezoning is consistent with the City's Comprehensive Plan for development; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the 48.24 acre tract mentioned above is hereby rezoned from A-O Agricultural-Open to R-1 Single Family Residential, effective immediately.
