AN ORDINANCE REZONING A 33.366 ACRE TRACT SITUATED IN THE MORGAN
RECTOR LEAGUE, ABSTRACT NO. 46, COLLEGE STATION, BRAZOS COUNTY,
TEXAS, AND BEING A PART OF THE SO-CALLED 112.86 ACRE TRACT OF LAND
CONVEYED TO EAST BY-PASS DEVF~I.OPMENT GROUP BY DEED RECORDED 1N
VOLUME 428, PAGE 297, DEED RECORDS, BRAZOS COUNTY, TEXAS, FROM A-O
AGRICULTURAL-OPEN AND R-I SINGLE FAMILY RESIDENTIAL TO R & D
RESEARCH AND DEVELOPMENT
WHEREAS, on Sune 27, 1996, the City Council of the City of College Station convened and,
pursuant to notices prescribed by law, held a public hearing with regard to the application for the
rezoning of a 33.366 acre tract or parcel of land situated in the Morgan Rector League, Abstract
No. 46, in the City of College Station, Brazos County, Texas, and more particularly described as
follows:
Being a 33.366 acrc tract or parcel of land lying and being situated in the Morgan Roctor
League, Abstract No. 46, College Station, Brazos County, Texas, and being a part of the
so-called 112.86 acre tract of land conveyed to East By-Pass Development Group by deed
recorded in Volume 428, Page 297, Deed Records, Brazos County, Texas, and said 33.366
acre tract being more particularly described as follows:
BEGINNING at a 5/8" iron rod found set in concrete for the south comer of the herein
described tract of land, said rod also marking the westernmost comer of Lot 4, Block 19,
Woodcreek Section 5 Subdivision, College Station, Brazos County, Texas as recorded in
Volume 1318, Page 171, Official Records, Brazos County, Texas;
THENCE N 30°11'49'' W, through the 112.86 acre tract, for a distance of 644.73' to a
THENCE N 45°36'18" W, through the 112.86 acre tract, for a distance of 689.30' to a
THENCE N 13°00'32'' W, through the 112.86 acre tract, for a distance of 575.45' to a
point;
THENCE N 45°36'18" W, through the 112.86 acre tract, for a distance of 150.00' to a
point for a comer located on the southeasterly right-of-way line of Sebesta Road;
THENCE N 44°25'10'' E, along said southeasterly right-of-way line of Sebesta Road, for
a distance of 210.00' to a point for a corner, said point also being the west comer of the
125.9 acre T.D. Letbetter Tract as recorded in Volume 136, Page 223, Deed Records,
Brazos County, Texas;
THENCE S 45°36'18" E, for a distance of 1,295.01', aiong the common boundary with
said Letbettcr Tract, to a ½" iron rod found, said rod also marking the south comer of thc
aforesaid T.D. Lethetter Tract;
THENCE N 45°38'47'' E, continuing along the common boundary with said Lotbetter
Tract, for a distance of 801.96' to a 6" Cedar fence post found for a comer;
THENCE S 46006'37'' E, for a distance of 624.72' to a 5/8" iron rod found, said rod
marking thc west comer of a College Station City Park Tract as recorded in Volume 918,

Page 678, Official Records, and fimhcrmom said rod marking tl~ northernmost corner of
Block 19, Woodcmok Section 5 Subdivision;
THENCE S 44004'33'' W, along thc common boundary with said Block 19, for a distance
of 1,498.60' to tho POINT OF BEGINNING, containing 33.336 acres of land mom or
less.
WHEREAS, on February 6, 1996, the property was rezoned to M-1 with the condition that deed
restrictions be filed making the City a party to the subdivision plat and the condition that the
applicant convey a small portion of land to the City to enable the City to enforce the deed restric-
tions;
WHEREAS, the zoning did not become effective because the property owner did not fulfill the
conditions required; and as a result the property is still zoned A-O Agricultural Open and R-1
Single Family Residential;
WHEREAS, the owner of the above-described property, East By-Pass Development Group, has
applied for the rezoning of the above-described property from A-O and R-1 to R & D Research
and Development;
WHEREAS, the current use of the property is agricultural or vacant;
WHEREAS, the City Council of the City of Colle. ~ge Station heard evidence as to the fact that the
proposed development will not have any negative Impacts to the adjacent residential properties;
WHEREAS, evidence was presented that the proposed zoning change is in accordance with the
Comprehensive Plan and proposed Comprehensive Plan; and
WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the
growth in College Station is primarily to the south and along State Highway 6 and that mixed use
development along State Highway 6 is appropriate for this area;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COLLEGE STATION, TEXAS, that the entire 33.366 acre tract described above is rezoned to
R & D, Research and Development, effective immediately.
