HomeMy WebLinkAbout1997-2261 - Ordinance - 08/28/1997ORDINANCE NO. 2261 AN ORDINANCE OF THE CITY OF COLLEGE STATION, TEXAS, ORDERING A SPECIAL MUNICIPAL ELECTION ON TUESDAY, NOVEMBER 4, 1997 REGARDING A CONVENTION CENTER; DESIGNATING THE TIME, PLACE AND MANNER FOR HOLDING THE ELECTION; AND, AUTHORIZING THE MAYOR TO SIGN AN OFFICIAL ORDER AND NOTICE OF ELECTION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: SECTION 1 The State of Texas has ordered a Special Election to be held on Tuesday, November 4, 1997. The City Council hereby orders a Special Election to be held on Tuesday, November 4, 1997 for the purpose of determining whether to proceed with constructing a Convention Center. Therefore, at the election to be held on the 4th day of November, 1997, there shall be submitted to the duly qualified resident electors within said city, for their action thereupon the following proposition, to wit: That said proposition shall be presented for "yes" or "no" in the following form: PROPOSITION NO. 1 "SHALL THE CITY COUNCIL OF THE CITY OF COLLEGE STATION PROCEED WITH THE CONSTRUCTION OF A CONVENTION CENTER" If said proposition shall receive a majority of "yes' votes it shall be declared passed. The results of said election shall be entered in the official records of the city. The election shall be held under the provisions of the laws of the State of Texas governing special elections, and only duly qualified voters who are residents of the City of College Station shall be allowed to vote in this election. Ordinance No. 2261 Page 2 Said election shall be held in conjunction with the Brazos County Special Election, whereby an election precinct is to be served by a common polling place and election judge. The implementation and actual management of this election shall be with the Brazos County Clerk. ^ single ballot form at each polling place shall be used, provided; however, that no voter shall be given a ballot containing any proposition on which the voter is ineligible to vote. The polls shall be opened promptly at 7:00 a.m. and shall be closed promptly at 7:00 p.m. The Office of the City Secretary shall assist the County Clerk in the performance of all duties related to the conduct of a general election. The City of College Station shall have 18 election polling places for this election designated in the NOTICE OF ELECTION, attached hereto. The election officers for each polling place shall be those appointed by the Brazos County Clerk for the November 4, 1997 countywide election. SECTION 2 Early voting shall be conducted by personal appearance and by mail. There shall be five early voting places: Brazos County Courthouse at 300 East 26th Street, Bryan, Texas, the Galilee Baptist Church at 804 North Logan Avenue, Bryan, Texas, the Arena Hall St 2904 Tabor Road, Bryan, Texas, the College Station School Administration Building at 1812 Welsh, College Station, Texas, and the Memorial Student Center, Texas A&M University, College Station, Texas. The early voting clerks shall be appointed and designated by the Brazos County Clerk in accordance with the election services contract between the City and County. The hours designated for early voting by personal appearance shall be from 8:00 a.m. to 5:00 p.m. on each day, except Saturdays, Sundays and official state holidays, during the period required by law for conducting early voting. The early voting locations will be open from 8:00 a.m. to 8:00 p.m. on October 30 and 31, 1997. For purposes of processing ballots cast in early voting, the election officers for the early voting ballot board for this election shall be appointed and designated in accordance with the provision of the election services contract between the City and County. The following persons are hereby appointed as the Early Ballot Board to count the early ballots: Ordinance No. 2261 Page 3 Presiding Judge: Clerks: Celia Goode Haddock To be named by the Presiding Judge SECTION 3 Punch card voting machines shall be used for voting at the election precincts and electronic count devices and equipment shall be used for counting the ballots at said election. SECTION 4 The Brazos Center, is hereby established as Central Counting Station to receive ballots for said election, the ballots to be tabulated and returned to the office of the County Clerk. The data processing personnel from Brazos County are authorized and approved as persons employed and designated to handle the ballots, operate the tabulating equipment, and count the ballots. The following state officials and other designated persons are hereby authorized to be present at the Central Counting Station to observe the election process: a. Mayor and members of the College Station City Council b. The City Secretary and designated members of staff c. The City Manager of the City of College Station d. The County Clerk of Brazos County e. The County Judge and members of the Commissioners Court of Brazos County f. The Attorney General of the State of Texas or his authorized representative SECTION $ A committee is hereby established consisting of the following persons to hold Computer Accuracy Test, including two tests prior to the official count and one test immediately after the count of the voted ballots, to ascertain that the computer will accurately count the votes cast for the propositions to be voted upon in said election: a. City Secretary of College Station and designated members of staff b. Brazos County Clerk and designated members of staff c. The presiding judge of Central Counting Station Ordinance No. 2261 Page 4 SECTION 6 The Mayor of the City of College Station is hereby authorized to sign an official ORDER OF ELECTION FOR THE CITY OF COLLEGE STATION, TEXAS as prescribed by the Texas Election Code, said ORDER OF ELECTION FOR THE CITY OF COLLEGE STATION to be attached hereto and recorded as part of this Ordinance. The Mayor of the City of College Station is hereby authorized to sign an official NOTICE OF GENERAL ELECTION as set forth in a form prescribed by the Secretary of State of Texas; and an English version and Spanish translation of the NOTICE OF GENERAL ELECTION, when published in a newspaper of general circulation in the City of College, shall serve as proper notice of the election ordered by this Ordinance. QUE SEA ORDENADO POR EL CONSEJO MUNICIPAL DE LA CIUDAD DE COLLEGE STATION, TEXAS: SECCION I El Estado de Texas ha ordenando una Elecci6n Especial que se Ileve a cabo el Martes, 4 de Noviembre, 1997. El Consejo Municipal ordena que una una Elecci6n Especial sea ejecutada el Martes, 4 de Noviembre, 1997 para el proposito de determinar proceder con la construccion de un Centro de Convenciones. Pot Io mismo, en la elecciOn que se Ilevara a cabo el 4 de Noviembre, 1997, sera submitido a los votantes residentes calificados de dicha ciudad, para su accion la siguiente proposicion, diciendo: Que dicha proposicion sera presentada para un "si' o 'no" en la siguiente forma: PROPOSlClON NO. 1 "DEBERA EL CONSEJO MUNICIPAL DE LA ClUDAD DE COLLEGE STATION PROCEDER CON LA CONSTRUCCION DE UN CENTRO DE CONVENCIONES" Si dicha proposicion recibe una mayoridad de votos "si', se declarara pasado. Los resultados de dicha elecci~Sn seran registrados en los archivos oficiales de la ciudad. La elecci(Sn se Ilevara a cabo bajo las provisiones de las leyes de el Estado de Texas govemando elecci(Snes generales, y solamente votadores calificados que son residentes de College Station seran permitidos votar en esta elecciOn. Decreto Municipal No. 2261 Pagina 2 Dicha elecckSn se Ilevara a cabo en conjunto con la ElecciOn Especial del Condado de Brazos, en Io que un precinto electoral sera servido por un lugar comun de elecci0n y juez electoral. La implementacion y manejo actual de esta elecci(Sn sera con la Secretaria del Condado. Un formulario de boleta electoral sero utilizado en cada precinto electoral, siempre que ningun votante sera otorgado una boleta electoral conteniendo cualquier proposicion en que el votante es inelegible para votar. Los precintos electorales abriran a las 7:00 a.m. y cerraran a las 7:00 p.m. La oficina de la Secretaria de la Municipalidad asistira a la Secretaria del Condado (County Clerk) en Ilevar a cabo las labores relacionados con la conducta de una elecci~Sn general. La Ciudad de College Station tendra 18 lugares electorales para esta elecci(Sn designada en la NOTIFICAClON DE ELECCl0N, adjunta. Los oficiales de elecci6n de cada lugar electoral seran esos nombrados pot la Secretaria del Condado para la elecci(Sn del condado que se Ilevara a cabo el 4 de Noviembre, 1997. SECCION 2 La votaci~Sn anticipada sera conducida en persona y por correo. Habran cinco lugares de votacion anticipada: Brazos County Courthouse en 300 East 26th Street, Bryan, Texas, la Galilee Baptist Church en 804 North Logan Avenue, Bryan, Texas, el Arena Hall en 2904 Tabor Road, Bryan, Texas, el edificio del College Station School Administration en 1812 Welsh, College Station, Texas, y el Memorial Student Center, Texas A&M University, College Station, Texas. Los agentes de votaci0n anticipada seran nombrados y designados por la Secretaria del Condado (County Clerk) en acuerdo con el contrato de servicios electomles entre la Ciudad y el Condado. Las horas designadas para votaci(Sn anticipada seran entre las horns de 8:00 a.m. y 5:00 p.m. de cada dia, con excepci6n de Sabados, Domingos, y feriados oficiales del estado, durante el periodo requerido por la ley para conducir votacion anticipada. Los lugares de votaci0n anticipada estaran abiertos de las 8:00 a.m. a 8:00 p.m. los dias 30 y 31 de Octubre, 1997. Para el proposito de procesar boletas anticipadas, los oficiales de elecciOn de el comite de votacion anticipada de esta elecokSn seran nombrados y designados en acuerdo con el contrato de servicios electorales entre la Ciudad y el Condado. Decreto Municipal No. 2261 Pagina 3 Las siguientes personas estan apuntadas como el Consejo de Votacion Anticipada para contar las boletas de anticipo: Juez Actual: Agentes: Celia Goode Haddock Sera nombrado por el Juez Actual SECCION 3 Las maquinas marca tarjetas seran utilizadas para votacion en dichos lugares electorales y equipo electronico de conteo sera utilizado para contar las boletas en dicha elecci6n. SECCl0N 4 El Brazos Center, esta designado como la Estacion Central de Conteo para recibir boletas de dicha elecci6n, y las boletas seran contados y devueltas a la oficina de la Secretaria del Condado (County Clerk). El personal de procesamiento de informacion del Condado de Brazos estan autorizados y aprovados como personas empleadas y designadas a manejar las boletas electorales, operar el equipo de conteo, y contar las boletas. Los siguientes oficiales del estado y otms personas designadas estan autorizadas para estar presente en la Estacion Central de Conteo para observar el proceso electoral: a. La Alcaldeza y miembros del Consejo Municipal de College Station b. La Secretaria Municipal y miembros designados de su oficina c. El Gerente Municipal de la Ciudad de College Station - d. El Secretario del Condado de Brazos. e. El Juez del Condado y miembros de la Corte de Comisionados del Condado de Brazos f. El Abogado General del Estado de Texas ~ su representante designado. SECCION $ Un comite esta establecido consistiendo de las siguientes personas para los Examenes de Exactitud de Conteo Computarizado, incluyendo dos examenes antes de el conteo oficial de boletas, y un examen inmediatamente despues del conteo de las boletas, para asegurar que la computadora contara corectamente los votos entregados para las oficinas elegidas por dicha elecciOn: Decreto Municipal No. 2261 P,~gina 4 a. El Juez Actual de la Estacion Central de Conteo SECCION 6 La Alcaldeza de la Ciudad de College Station esta autorizada firmar una ORDEN OFIClAL DE ELECION EN LA ClUDAD DE COLLEGE STATION, TEXAS como prescrito por el Codigo Electoral del Estado de Texas, y dicha una ORDEN OFIClAL DE ELECCION EN LA CIUDAD DE COLLEGE STATION que sera adjuntado y anotado como parte de este Decreto Municipal. La Alcaldeza de la Ciudad de College Station esta autorizada firmar una NOTIFICACION OFICIAL DE ELECCION GENERAL como prescrito en el formulario otorgado por la Secretaria del Estado de Texas, y una version en Ingles y una traducci6n en Espattol de NOTIFICAClON OFICIAL DE ELECCION GENERAL, cuando publicado en un periodico de circulaci6n general en la Ciudad de College Station, servira como notificacion adecuada de la elecci6n ordenada por este Decreto Municipal.
