AN ORDINANCE VACATING AND ABANDONING TWO TWENTY FOOT WIDE
UTILITY EASEMENTS CONVEYED TO THE CITY OF COLLEGE STATION, BY
INSTRUMENT RECORDED IN VOLUME 368, PAGE 362 AND VOLUME 820,
PAGE 258, OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS.
WHEREAS, the City of College Station has received an application for the aban-
donment of two twenty foot (20') wide utility easements conveyed to the City of
College Station, by instrument recorded in Volume 368, Page 362 and Volume
820, Page 258, of the Official Records of Brazos County, Texas; said utility
easements being more particularly described in Exhibits "I-A' and "l-B" attached
hereto; and
WHEREAS on August 12, 1997, the City Council of the City of College Station,
Texas, heard the application of Clarke and Wyndham, Inc./Flagship Development
and Mohawk LTD., for the vacation and abandonment of the aforementioned
twenty foot (20') wide utility easements conveyed to the City of College Station, by
instrument recorded in Volume 368, Page 362 and Volume 820, Page 258, of the
Official Records of Brazos County, Texas;
NOW, THEREFORE, be it ordained by the City Council of the City of College
Station, Texas, that the twenty foot (20') wide strip of land previously dedicated as
utility easements conveyed to the City of College Station, by instrument recorded
in Volume 368, Page 362 and Volume 820, Page 258, as described in Exhibits "l-
A' and "l-B" attached hereto, be abandoned and vacated; that the Mayor and the
City Secretary be authorized to convey by quit claim deed on behalf of the City of
College Station any right or claim that the City has in and to said twenty foot (20')
wide strip of land to the property owners, Clarke and Wyndham, Inc./Flagship
Development and Mohawk LT_D. _

ABANDONMENT OF 20.0-FOOT-WIDE WATER LINE EASEMENT

Being a portion of a 20:0-foot wide water line easement conveyed to the City of College
Station, Texas by instrument recorded in Volume 368, Page 362 of the Deed Records of
Brazos County, said easement lying within the abandoned International and Great Northern
Railroad right-of-way adjacent to a called 47.27-acre tract fwm Marion C. Pugh and wife,
Helen Pugh, to Mohawk, Ltd. as described in a deed recorded in Volume 326, Page 869 of the
Deed Records of Brazos County, and also being situated in the Crawford Burner League,
Abstract No. 7, Brazos County, Texas, and being 10-feet on each side of the centerline more
particularly described as follows:
BEGINN~G at a point, said point bearing South 57024'00'' West, a distance of 922.13 feet
from the ~tersection of the southwest right-of-way line of the Southern Pacific l~ilroad and
the center line of a 20.00 foot wide water line easement recorded in Volume 360, Page 49 of
the Deed Records of Brazos County, Texas;
THENCE, South 57024'00` West, a distance of 84.23 feet to a point for a horizontal P.I.;
TI-~-NCE, North 18°45'00'' West, along the abandoned I & GN Railroad right-of-way a
distance of 686.39 feet to a point for a horizontal P.I.;
THF~NCE, North 63°45'00'' West, a distance of 30.00 feet to a point for a horizontal P.I.;
TI-~NCE, North 18045'00'' West, a distance of 32.44 feet to a point for a horizontal P.I.;
THENCE, North 26°15'00' East, a distance of 30.00 feet to a point for a horizontal P.I.;
THENCE, North 18045'00'` West, a distance of 1129.45 feet to a point for termination, said
point bearing North 45020'40" Fast (called North 44°26'40" East) from the southeast corner
of Woodway West, Phase I, a final plat of which is recorded in Volume 583, Page 177, of the
Brazos County Map Records.

Being a 20-foot strip of land conveyed to the City of College Station, Texas, by instrument
recorded in Volume 820, Page 258, of the Official Records of Brazos County, lying within a
called 3.8862-acre tract as described in a Quit Claim Deed to Robert Calloway Corporation
recorded in Volume 761, Page 11, of the Official Records of Brazos County, Texas, and also
being situated in the Crawford Bumett League, Abstract No. 7, Brazos County, Texas, and
being 10 feet on each side of the center line more particularly described as follows:
BEGINNING at a point in the southeast line of the abovementioned 3.8862-acre tract and
being located North 63°08'12'' East, 20.16 feet from the South comer of same, said South
comer also being located in the centerline of the I & ON Railroad abandoned right-of-way;
THRNCB, North 19°39'00~ West, parallel with and 20.00 feet from a southwest line of he
said 3.8862 acre tract, same being the centerline of the I & GN Railroad abandoned right-of-
way, for a distance of 1276.14 feet to the end of this 20-foot wide utility easement, said point
being a middle northwest line of the said 3.8862-acre tract and being a curve concave to the
southeast having a radius of 984.93 feet, said curve also being the northwest right-of-way line
of Holleman Drive, said ending point also being located by a chord of North 50018'08'' East,
31.94 feet from the East corner of Lot I, Block 2, of the Revised Final Plat of Woodway West
Phase I Addition to the City of College Station, Texas, said Final Plat being recorded in
Volume 705, Page 619, of the Deed Records of Brazos County, Texas.
