HomeMy WebLinkAbout1996-2223 - Ordinance - 11/20/1996ORDINANCE NO. 2223 AN ORDINANCE REZONING A 3.5 ACRE TRACT SITUATED IN THE ROBERT STEVENSON LEAGUE A-54, BRAZOS COUNTY, TEXAS, AND BEING A PORTION OF THE 159.657 ACRE TRACT CONVEYED BY LIEVEN J. VAN RIET ET AL TO LIEVEN J. VAN RIET, TRUSTEE BY DEED RECORDED IN VOLUME 964, PAGE 818 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS, FROM C-3, PLANNED COMMERCIAL TO C-2, COMMERCIAL-INDUSTRIAL. WHEREAS, on November 20, 1996, the City Council of the City of College Station convened and, pursuant to notices prescribed by law, held a public hearing with regard to the application for the rezoning of 3.5 acres situated in the Robert Stevenson League A-54, Brazes County, Texas, and more particularly described as follows: Being all that certain tract or parcel of land lying and being situated in the ROBERT STEVENSON SURVEY, Abstract No. 54, in College Station, Brazes County, Toms, and being a portion of the 159.657 acre tract conveyed by Lievon J. Van Ri~t et al to Lieven $. Van Rift, Trustee by Deed recorded in Volume 964, Page 818, of the Official Records of Brazes County, Texas, and being more particularly described by metes and bounds as follows: BEGINNING: at a l/2-inch iron rod found for the most westerly comer ora 2.481 acre Right-of-Way Dedication tract for Mortier Drive (a 60-foot svide Right-of-Way) as described in Volume 2247, Page 336, of the Official Records of Brazes County, Texas, said iron rod also being in the northeast fight-of-way line of FM 2154/Wellborn Road (based on a 100-foot width); THENCE: N 47° 03' 58" W along said FM 2154 for a distance of 336.03 feet to a 1/2- inch iron rod set for comer; THENCE: N 42° 56' 02" E into the interior of the said 159.657 acre tract for a distance of 422.94 feet to a l/2-inch iron rod set for comer; THENCE: S 48° 1 I' 59" E for a distance of 354.24 feet to a l/2-inch iron rod set for comer, said iron rod also being in the northwest fight-of-~vay line of the beforementioned Mortier Drive; THENCE: S 41° 57' 50" W along Merrier Drive for a distance of 404.58 feet to a 1/2- inch iron rod found for thc Point of Curvature ora curve to the right; THENCE: 39.69 feet along the arc of said curve having a central angle of 90° 58' 12", a radius of 25.00 feet, a tangent of 25.43 feet and a long chord bearing S 87° 26' 56" W at a distance of 35.65 feet to the POINT OF BEGINNING and containing 3.500 acres of land, more or less. WHEREAS, the above-described property is currently zoned C-3, Planned Commercial, and the current use is agriculture; WHEREAS, thc owner of thc above-described property, Lieven J. Van Rift, has applied for the rezoning of the above-described property to C-2, Commercial Industrial; lah~o:~grou, pllegalL.'e~onmglvanret£doc ORDINANCE NO. 2223 PAGE 2 WHEREAS, the City Council of the City of College Station, Text, heard evidence as to the location of the above-described property, on the northeast corner of Wellborn Road and Mortier; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the proposed use of the above-described property as a pet grooming and boarding service with ancillary services is compatible with the current C-3 classification; WHEREAS, evidence was presented that the proposed use as a pet grooming and boarding service with ancillary services requires a rezoning of the above-described property to C-2, Commercial-Industrial; WHEREAS, evidence was presented that the proposed zoning change is in accordance with the City's Comprehensive Plan for development; and WHEREAS, the City Council of the City of College Station, Texas, conditioned approval upon the following: upon development, the property, owner will install a landscape buffer zone along the entire common boundary between the subject tract and the R-1 zoned area to the east. The buffer will be installed in accordance with the standards as provided in the Research and Development zoning district. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the 3.5 acres situated in the Robert Stevenson League A-54, Brazos County, Texas and described above is rezoned to C-2, Commercial Industrial, effective immediately. PASSED and APPROVED this 20th day of November, 1996.
