AN ORDINANCE REZONING TWO PARCELS OF LAND BEING LOTS FOUR (4), FIVE (5), SIX
(6), AND SEVEN (7), BLOCK FOUR (4), AND LOT THREE (3), BLOCK THREE (3), POOH'S
PARK SUBDMSION AND A 14.7412 ACRE TRACT SITUATED IN THE MORGAN RECTOR
LEAGUE A-46, BRAZOS COUNTY, TEXAS, CONVEYED TO OWNER, POOH'S PARK
DEVELOPMENT, LTD., BY DEED RECORDED IN VOLUME 2242, PAGE 20, OF TIlE DEED
RECORDS OF BRAZOS COUNTY, TEXAS, FROM WPC, WOLF PEN CREEK DEVELOPMENT
CORRIDOR, TO C-l, GENERAL COMMERCIAL.
WHEREAS, on November 20, 1996, the City Council of the City of College Station convened and,
pursuant to notices prescribed by law, held a public hearing with regard to the application for the rezoning
of Lots Four (4), Five (5), Six (6), and Seven (7), Block Four (4), and Lot Three (3), Block Three (3),
Pooh's Park Subdivision, and a 14.7412 acre tract situated in the Morgan Rector League, Brazes County,
Texas, and more particularly described as follows:
TRACT 1:14.7412 acres, more or less, in the Morgan Rector League, Brazes County,
Texas, said property being more particularly described by metes and bounds in Exhibit
"A' attached hereto and made a part hereof for all purposes.
TRACT 2: Lots Four (4), Five (5), Six (6), and Seven (7), Block Four (4), Pooh's Park
Subdivision, Section One, a subdivision located in College Station, Brazes County, Texas,
aocording to the plat thereof recorded in Volume 314, Page 618, of the Deed Records of
Brazes County, Texas.
TRACT 3: Lot Three (3), Block Three (3), Pooh's Park Subdivision, Section One, a
subdivision located in College Station, Brazes County, Texas, according to the plat thereof
recorded in Volume 314, Page 618, of the Deed Records of Brazes County, Texas.
WHEREAS, the above-described property is currently zoned WPC, Wolf Pen Creek Development
Corridor;
WHEREAS, the above-described property is currently used as offieedcommercial space including a
furniture store, a chiropractic office and a resale shop;
WHEREAS, the owner of the above-described property, Pooh's Park Development, Ltd., has applied for
the rezoning of the above-described property to C-l, General Commercial;
WHEREAS, the City Council of the City of College Station, Te.~, heard evidence as to the location of the
above-described property at 1907 Texas Avenue, 105 Holleman Drive, and 207 to 213 Holleman Drive;
WHEREAS, the City Council of the City of College Station, Texas, heard evidence that the property fronts
on Texas Avenue, and is bound by Wolf Pen Creek to the North, the proposed extension of Kyle South on
the East, and lots fronting Holleman Drive on the South;
WHEREAS, evidence was presented that the above-described property is best suited for commercial
development facing and with access from Texas Avenue;
WHEREAS, the subject rezoning is consistent xvith the City's Comprehensive Plan for development; and

WHEREAS, the City Council of the City of College Station, Texas, conditioned approval upon the
following: that provisions are made for implementation of the Wolf Pen Creek Master Plan relative to the
floodway and minimum reservation area as defined in the Master Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE
STATION, TEXAS, that Lots Four (4), Five (5), Six (6), and Seven (7), Block Four (4), and Lot Three
(3), Block Three (3), Pooh's Park Subdivision, and a 14.7412 acre tract situated in the Morgan Rector
League, Brazos County, and described above is rezoned to C-l, General Commercial, effective
immediately.
PASSED and APPROVED this 20th day of November, 1996.

Metes and bounds description of all that certain tract or parcel of land, lying and being
situated in the Morgan Rector League, Abstract No. 46, College Station, Brazos County, Texas.
Said tract being comprised of the following tracts of land:
1 .) The remainder of a called 33.36 acre tract as described by a deed to Don R. Dale,
recorded in Volume?275, Page 113 of the Deed Records of Brazos County,
Texas;
2.) All of a called 4.70 acre tract as described by a deed to Don Dale, recorded in
Volume 275, Page 31 of the Deed Records of Brazos County, Texas;

Said tract being more particularly described by metes and bounds as follows:
BEGINNING at a 5/8 inch iron rod set marking the South comer of a called 8.0 acre tract as
described by a deed to Phillip O. E. Vandekerckhove, recorded in Volume 566, Page 328 of the Deed
Records of Brazos County, Texas and the East comer of a called 33.36 acre tract, said iron rod also
being on the Northwest line of Lot 7, Block 4 of the aforementioned Pooh's Park Subdivision, Section
One;
TI~.NCE: S 41° 31' 31" W along a Northwest line of said Pooh's Park Subdivision for a distance
of 655.75 feet to a 5/8 inch iron rod set at the North comer of Pooh Lane (50' R.O.W.). This line
was used for bearing orientation, honoring the Plat called bearings of the aforementioned Pooh's Park
Subdivision;
THENCE: S 44° 10' 08" W continuing along the Northwest lines ofsaid Pooh's Park Subdivision
