HomeMy WebLinkAbout1996-2221 - Ordinance - 11/20/1996ORDINANCE NO. 2221 AN ORDINANCE REZONING A 3.25 ACRE TRACT SITUATED IN THE ROBERT STEVENSON LEAGUE A-54, BRAZOS COUNTY, TEXAS, CONVEYED TO OWNER, LYNN WHITE, BY DEED RECORDED IN VOLUME 1613, PAGE 57 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS, FROM M-2, HEAVY INDUSTRIAL, TO C-2, COMMERCIAL INDUSTRIAL. WHEREAS, on November 20, 1996, the City Council of the City of College Station convened and, pursuant to notices prescribed by law, held a public hearing with regard to the application for the rezoning of 3.25 acres situated in the Robert Stevenson League A-54, Brazos County, Texas, and more particularly described as follows: Being all of that certain tract or parcel of land lying and being situated in ROBERT STEVENSON LEAGUE 1-54, Brazos County, Texas, and being all of that 3.25 Acre Tract (called 3.28 Acres) described in a Substitute Tmstee's Deed recorded in Volume 1130, Page 103, of the Official Records of Brazos County, Texas, and being more particularly described as follows: BEGINNING: at a 5/8" iron rod found at the south comer of said 3.25 acre tract, same being in the northwest right-of-way line of Graham Road; THENCE: N 44° 36' 06" W - 388.96 feet to a 5/8" iron rod found at the west comer of this tract; THENCE: N 45° 24' 00" E - 352.42 feet to a 1/2" iron rod set for the north comer of this tract; THENCE: S 44° 34' 35" E - 434.78 feet to a 1/2" iron rod set for the east comer of this tract, same being in said northwest line of Graham Road; THENCE: S 58° 49' 23" W - 198.79 feet and S 45° 16' 56" W - 158.87 feet along said Graham Road line to the PLACE OF BEGINNING and containing 3.25 acres of land more or less. WHEREAS, the above-described property is currently zoned M-2, Heavy Industrial, and the current use is as a vacant warehouse; WHEREAS, the owner of the above-described property, Lynn White, has applied for the rezoning of the above-described property to C-2, Commercial Industrial; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that land use of the property to the north, east and south of Graham Road is either residential, retirement home, or city parks; WHEREAS, the City Council of the City of College Station, Texas, heard evidence that current land uses of other properties on Graham Road are C-2, Commercial Industrial, including properties originally intended as Heavy Industrial under the Comprehensive Plan; lah~c. ~wmdowslwtnword~uscrfil~ordtnanclwhtteord. doc ORDINANCE NO. 2221 PAGE 2 WHEREAS, the City Council of the City of College Station, Texas, heard evidence that re, zoning the above-described property to C-2, Commercial Industrial, will permit the vacant building located on said property to be used as a gymnastics facility; and WHEREAS, the City Council of the City of College Station, Texas, has determined that the rezoning of the above-described property to C-2, Commercial Industrial, will be more compatible with current and future land use of property on Graham Road; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the 3.25 acres situated in the Robert Stevenson League A- 54, Brazos County, Texas and described above is rezoned to C-2, Commercial Industrial, effective immediately.
