HomeMy WebLinkAbout1998-2307 - Ordinance - 02/26/1998ORDINANCE NO. 2307 AN ORDINANCE VACATING AND ABANDONING A 0.395 ACRE TRACT, BEING A PORTION OF A TWENTY-FOOT WIDE PUBLIC UTILITY EASEMENT, LOCATED WITHIN LOT 4A, BLOCK 1, OF THE REPLAT OF THE MELROSE SUBDMSION, IN TttE CITY OF COLLEGE STATION, BRAZOS COUNTY, TEXAS. WHEREAS, the City of College Station has received an Application for the Abandonment of a portion of a twenty foot wide public utility easement, located within Lot 4A, Block 1, of the Replat of the Melrose Subdivison, in the City of College Station, said easement being more particularly described in Exhibit "A" attached hereto; and WHEREAS, on February 26, 1998, the City Council of the City of College Station, Texas heard the application of Melrose Apartments of College Station, Ltd. for the vacation and abandonment of the aforementioned twenty foot wide public utility easement, located within Lot 4A, Block 1 of the Replat of the Melrose Subdivision, according to the plat recorded in Volume 3020, Page 89, of the Deed ofRecords of Brazos County, Texas; NOW, THEREFORE, be it ordained by the City Council of the City of College Station, Texas, that the portion of the twenty foot wide public utility easement, located within Lot 4A, Block 1 of the Replat of the Melrose as described by metes and bounds on Exhibit "A" attached hereto, be abandoned and vacated. REPLAT OF MELROSE SUBDIVISION FN NO. 98-030 (MM) FEBRUARY 2, 1998 BPI JOB NO. 759-04.21 DESCRIPTION OF A 0.395 ACRE TRACT SITUATED IN THE CITY OF COLLEGE STATION, BRAZOS COUNTY, TEXAS, BEING A PORTION OF LOT 4A, BLOCK 1, REPLAT OF LOTS 1-3, MELROSE SUBDIVISION (LOTS lA, 2A, 3A, AND 4A), A SUBDIVISION OF RECORD IN VOLUME 3020, PAGE 89 OF THE OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS; SAID 0.395 ACRES BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: BEGINNING, at a 1/2 inch iron rod found in the irregular easterly line of said Lot 4A, being the irregular westerly line of Woodway Village Section Two, a subdivision of record in Volume 525, Page 645 of said Official Records, same being the point of curvature of a curve to the left, from which a 1/2 inch iron rod found in the southerly right-of-way line of Jones-Butler Road (80' R.O.W.), being the northeasterly corner of said Lot 4A, same being the northwesterly corner of said Woodway Village Section Wwo bears N44°29'16"E, a distance of 167.08 feet; THENCE, along the irregular easterly line of said Lot 4A, being the irregular westerly line of said Woodway Village Section Two, same being along said curve to the left having a radius of 859.05 feet, a central angle of 12°23'17'', an arc distance of 185.74 feet and a chord which bears S38°17'38"W, a distance of 185.38 feet to the end of said curve; THENCE, leaving the irregular westerly line of said Woodway Village Section Two, over and across said Lot 4A, the following three (3) courses and distances: 1) S44°29'16"W, a distance of 799.49 feet to a corner hereof; 2) N47"47'58"W, a distance of 20.02 feet to a corner hereof; 3) N44°29'16"E, a distance of 984.58 feet to the POINT OF BEGINNING, containing an area of 0.395 acres (17,221 sq. ft.) of land, more or less, within these metes and bounds.
