AN ORDINANCE REZONING A PARCEL OF LAND TOTALING 6.32 ACRES LOCATED
IN THE ROBERT STEVENSON LEAGUE, ABSTRACT NO. 54 IN COLLEGE STATION,
BRAZOS COUNTY, TEXAS, AND BEING THE 2.32 ACRE TRACT AS DESCRIBED IN A
DEED RECORDED IN VOLUME 3166, PAGE 262; AND, A 4.00 ACRE TRACT AS
DESCRIBED IN A DEED RECORDED IN VOLUME 3166, PAGE 274, BOTH BEING
OFFICIAL RECORDS OF BRAZOS COUNTY, TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1:
That the City of College Station Zoning Ordinance #1638,
Official Zoning Map, be amended as set out in Exhibits "A",
hereto and made a part of this ordinance for ali purposes.
more specifically the
"B" and "C" attached
PART 2:
That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections ofthis ordinance, which shall remain in flail force and effect.
PART 3:
That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25 00) nor more than Two
Thousand Dollars ($2000.00). The owner of any building shall be placed or shall
~xist, shall be guilty of a separate offense and upon conviction thereof shall be fined as
herein provided.
PART 4:
A notice of the time and place, where and when said ordinance would be given a
public hearing and considered for final passage, was published in The Eagle, a daily
newspaper of general circulation in the Cities of Bryan and College Station, said
publication being on Wednesday, August 12, 1998, the same being at least fifteen (15)
days prior to a public heating to be held in the Council Room of the City Hall in
College Station, Texas, at 7:00 p.m., on Thursday, August 27, 1998, to permit the
public to be heard prior to final consideration of this ordinance.
PASSED, ADOPTED and APPROVED this 27th day of August, 1998.

That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance #1638,
is hereby amended as follows:
The subject 6.32 acre tract described by metes and bounds in the attached Exhibit "B"
and shown graphically in Exhibit "C" is rezoned from A-O Agricultural Open to C-I
General Commercial.

HARLEY SUBDIVISION
All tha~ certain lot, tract, or parcel of land being 6.32 acres situated in the ROBERT
STEVENSON LEAGUE, Abstract No. 54, City of College Station, Brazos County, Texas,
and being all of the following tracts,
1) 2.32 acres as described in deed from Stephen Vaughn et ux to Russell and Sharon
Welch, dba Russ Welch Harley-Davidson, of Record in Volume 3166, Page 262. and
2) 4.00 acres as described in deed from Russell Welch et ux to By Pass Land Partners,
L.P., of Record in Volume 3166, Page 274, both being Official Records of Brazos
County, Texas, said 6.32 acre tract being more particularly described by metes and
bounds as follows:
BEGINNING at a 3/8' Iron Rod found in the northeast line of the Parent Called 19.31
acre tract as described in Volume 363, Page 730, for the most easterly corner, same
being the most easterly comer of said 2.32 acre tract and also being the most northerly
comer of Michael Barker Called 4.995 acre tract as described in Volume 2201, Page
160, said corner being N 45'36'53" Wa distance of 717.14 feet from a 3/8" Iron Rod
found for the most easterly comer of said Called 19 31 acre tract;
THENCE S 46'13'09' W along the southeast line of said 2,32 acre tract a distance of
325.68 feet to a ½" Iron Rod found in the northeast nght-of-way line of said STATE
HIGHWAY 6 for the most Southerly corner, same bemg the most southerly comer of
said 2.32 acre tract, and also being the most westerly corner of satd Called 4.995 acre
tract;
THENCE N 47'19'43' W along the northeast right-of-way line of said STATE HIGHVVAY
6 a distance of 820.72 feet to a ½" Iron Rod found for the most westerly comer, said
comer being the most westerly comer of said 4.00 acre tract and being S 47'19'43" E a
distance of 50.19 feet from a concrete monument found;
THENCE N 47'49'52' E along the northwest line of said 4.00 acre tract a distance of
350.69 feet to a ½' Iron Rod found for the most northerly comer, said comer being the
most northerly comer of said 4.00 acre tract;
THENCE S 45"36'53' E along the northeast line of said 4.00 acre tract and 2.32 acre
tract respectively, e distance of 809.70 feet to the PLACE OF BEGINNING AND
CONTAINING AN AREA OF 6.32 ACRES OF LAND MORE OR LESS
