AN ORDINANCE REZONING FOUR TRACTS OF LAND TOTALING 15.148 ACRES,
BEING SITUATED IN THE MORGAN RECTOR SURVEY, ABSTRACT 46, BRAZOS
COUNTY, TEXAS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:

That the City of College Station Zoning Ordinance #1638, more specifically the
Official Zoning Map, be amended as set out in Exhibits "A", "B", and "C" attached
hereto and made a part of this ordinance for all purposes.
That if any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holding shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
That any person, firm or corporation violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be
punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than Two
Thousand Dollars ($2000.00). Each day such violation shall continue or be
permitted to continue, shall be deemed a separate offense. Said Ordinance, being a
penal ordinance, becomes effective ten (10) days after its date of passage by the City
Council, as provided by Section 35 of the Charter of the City of College Station.

That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance
#1638, is hereby amended as follows:
The following property is rezoned fi.om R-1 Single Family Residential to R-5
Apartment Medium Density.
Tract ,4 - ,4 2.91 acre tract recorded in Volume 2956, Page 171, of the Official
Records of Brazos County, Texas, (see Volume 273, Page 477 for complete
description). Described by metes and bounds in the attached Exhibit "B" and shown
graphically in Exhibit "C".
Tract B - ,4 2.995 acre Tract One and 2.994 acre Tract Two described as Lots 3 and 4,
Williams-Winder-King ,4ddition, recorded in Volume 2877, Page 149, of the Official
Records of Brazos Count),, Texas, (see Volume 2682, Page 118 for complete
description). Described by metes and bounds in the attached Exhibit "B" and shown
graphically in Exhibit "C".
Tract C- ,4 2.998 acre tract recorded in Volume 2325, Page 205 of the Deed Records
of Brazos Count),, Texas. Described by metes and bounds in the attached Exhibit "B"
and shown graphically in Exhibit "C".
Tract D- ,4 3.173 acre tract recorded in Volume 517, Page 156 of the Deed Records of
Brazos County, Texas. Described by metes and bounds in the attached Exhibit "B" and
shown graphically in Exhibit "C".
The property is rezoned with the following condition:
1. That there be only one access driveway to Krenek Tap Road for the entire 15.148
acre tract as described herein.

and being all of the following four tracts:
1) 2.991 acres described in the deed from John E. Honea and Gerda Honea
to C. W. Henry and wife, Elizabeth A. Henry, recorded in Volume 2956,
Page 171, of the Official Records of Brazos County, Texas, (see Volume
273, Page 477 for complete description);
2) 2.995 acre Tract One and 2.994 acre Tract Two erroneously described
as Lots 3 and 4, Williams-Winder-King Addition, in the deed from John
R. Henry to C. W. Henry, recorded in Volume 2877, Page 149, of the
Official Records of Brazos County, Texas, for a complete and accurate
description see Volume 2682, Page 118, of the Official Records of

4) 3.173 acre tract described in the deed from Joanna Boatman to Alfred
A. Martin and Kenneth C. Krenek, recorded in Volume 517, Page 156,
of the Deed Records of Brazos County, Texas, and being more
particularly described as follows:
BEGINNING at the R' iron rod found marking the common corner between the
beforementioned Henry - 2.991 acre tract and the 8.973 acre tract described in the
deed to THM recorded in Volume 3051, Page 181, of the Official Records of Brazos
County, Texas, said ~" iron rod also being in the southeast line of Dartmouth
Crossing Addition according to the plat recorded in Volume 3127, Page 15, of the
Official Records of Brazos County, Texas;
THENCE N 44° 40' 30' E along the common line between the beforementioned
four tracts, Henry 2.991 acres, Henry 2.994 acres, Henry 2.995 acres, Killion 2.998
acres, Martin 3.173 acres, lying to the southeast and the beforementioned Dartmouth
Crossing Addition and the southeast line of Block 1, Southwest Crossing according
to the plat recorded in Volume 523, Page 433, of the Deed Records of Brazos
County, Texas, lying to the northwest, for a distance of 877.79 feet to a ½' iron rod
found marking the common corner between the beforementioned Martin - 3.173 acre
tract and the 9.143 acre Tract One described in the deed to Henryetta Madison,
recorded in Volume 334, Page 362, of the Deed Records of Brazos County, Texas;

right-of-way line of Krenek Tap Road;
THENCE S 45° 06' 02" W along the northwest right-of-way line of Krenek Tap
Road - 60' right-of-way for a distance of 872.52 feet to a ½' iron rod found marking
the common southerly corner between the beforementioned Henry - 2.991 acre tract
and the THM - 8.973 acre tract;
THENCE N 44" 53' 25' W along the common line between the
beforementioned Henry - 2.991 acre tract and the THM - 8.973 acre tract, for a
distance of 756.44 feet to the PLACE OF BEGINNING, containing 15.15 acres of land,
more or less.
