AN ORDINANCE OF THE CITY OF COLLEGE STATION, TEXAS, ESTABLISHING A
MUNICIPAL COURT TECHNOLOGY FUND; PROVIDING FOR THE ASSESSMENT AND
COLLECTION OF A MUNICIPAL COURT TECHNOLOGY FEE; PROVIDING FOR A
SEVEKABILITY CLAUSE; PROVIDING FOR AN EXPIRATION DATE; AND PROVIDING
FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, THAT:
PART 1: There is hereby created and established a Municipal Court Technology Fund
(hereinafter known as "the Fund"), pursuant to Article 102.0172 of the CODE OF
CRIMINAL PROCEDURE. The Fund may be maintained in an interest-bearin~
general revenue account.
PART 2: That a fee of Four Dollars ($4.00) shall be assessed and collected as a cost of court
from each defendant upon conviction in the Municipal Court for a misdemeanor
offense committed on or after November 1, 1999. Each defendant is considered
convicted if a sentence is imposed on the defendant; the defendant is placed on
community supervision, including deferred adjudication; or the court defers final
disposition of the defendant's case. The clerk ofthe court shall collect the fee and
pay the fee to the Director of Fiscal Services of the City of College Station, or his
delegate, who shall deposit the fee into the Municipal Court Technology Fund.
PART 3: The Fund shall be used only to finance the purchase of technological enhancements
for the Municipal Court of the City of College Station, Texas, including: computer
systems; computer networks; computer hardware; computer software; imaging
systems; electronic kiosks; electronic ticket writers; and docket management
systems. The Fund shall be administered by or under the direction of the City
Council of the City of College Station, Texas.
PART 4: If any provisions of any section of this ordinance shall be held to be void or
unconstitutional, such holdings shall in no way effect the validity of the remaining
provisions or sections of this ordinance, which shall remain in full force and effect.
PART 5: All ordinances and parts of ordinances in conflict with this ordinance are hereby
repealed to the extent of conflict with this ordinance.

In accordance with Article 102.0172 of the CODE OF CRIMINAL PROCEDURE, this
ordinance and the assessment and collection of the Municipal Court Technology
fee expires September 1, 2005. The purpose and the use of any funds remaining in
the Fund shall continue to be used and administered as required by this ordinance
and for that purpose this ordinance remains in effect.
This Ordinance becomes effective immediately upon passage by the City Council.
