A RESOLUTION RELATING TO LEGISLATION THAT WOULD CLARIFY WHAT
SERVICES ARE INCLUDED UNDER " THE SERVICES OF A FIRE DEPARTMENT".
WHEREAS, H.B. 785, "Interlocal Contracts", amended the Interlocal Cooperation Act, Chapter
791 of the Government Code, Section 791.006, "Liability in Fire Protection Contract" from "fire
protection services" to "the services of a fire department"; and
WHEREAS, the role of fire departments has changed greatly from the historic one of providing
only fire suppression service, to one of providing many services, that may include, along with
fire suppression, life hazard and fire safety inspections, hazardous materials incident response,
technical rescue, emergency medical service, and dive rescue; and
WHEREAS, the variety of services provided by a fire department may vary greatly from
jurisdiction to jurisdiction; now, therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, that the City endorse legislation that would amend Chapter 791 of the Texas
Government Code, Section 791.006, (a), to clarify that not only fire suppression service, but all
services provided by fire departments, fall under the Interlocal Cooperation Act and change the
title of Section 791.006 to "Liability in Fire Department Contracts or Provision of Law
Enforcement Services."
