HomeMy WebLinkAbout09-27-01-11.08 - Resolution - 09/27/2001 (2)RESOLUTION NO. 9-27-2001-11.08 A RESOLUTION RELATING TO THE ESTABLISHMENT OF A SUBCOMMITTEE BY THE TEXAS FIRE COMMISSION FOR THE PURPOSE OF ADOPTING NFPA STANDARD 1710 OR SIMILAR STANDARD AND THE EROSION OF THE POWERS OF TEXAS MUNICIPALIITES IN REGARD TO THE GOVERNANCE AND MANAGEMENT OF CITIES. WHEREAS, Texas cities have been created and empowered by the people to carry out the protection of mutual health, safety, and welfare of their citizens; and WHEREAS, the Texas Constitution grants the power to carry out these sacred duties by elected officials for the cities having been elected by the citizens whom they are directly accountable to; and WHEREAS, the prudent and responsible management of the affairs of these cities of Texas requires that public officials have the maximum ability and powers to meet their sworn duties without the imposition of unrealistic standards and mandates that require the expenditure of local tax revenues and the erosion of local control; and WHEREAS, the introduction and adoption of a nationally recognized standard that erodes local government authority or effectively places unfounded mandates upon our citizens threatens the sovereign powers delegated to Texas cities by the constitution; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the City does hereby urge the Texas Municipal League, an association of cities and towns in Texas, delegates assembled at this 2001 Annual Conference to oppose: 1. The formation of any technical subcommittee under the Texas Fire Commission or other state agency for the purpose of adoption of NFPA Standard 1710 or similar standard for the Texas Fire Service; and 2. Oppose any legislation that would: a. Create new obligations on the part of Texas cities to provide services at unreasonable levels without regard to the necessary funding to carry out the spirit and provisions of such standards; and b. Limit or remove the rights of Texas cities to control the establishment of an acceptable level of service, based upon local conditions, codes, and ordinances, and economy; and c. Establish grounds for unrealistic and unnecessary liability for cities, their employees, and their governing bodies. BE IT ALSO RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that the city does hereby state direct opposition to the adoption of the Nation Fire Protection Association Standard 1710 or similar legislation or rules.
