KNOW ALL BY THESE PRESENTS:
That, Bryan Commerce and Development Inc., with offices at 300 South Texas Avenue, Bryan, Brazos County,
Texas, the undersigned property owner (Grantor), for good and valuable consideration, the receipt of which is
hereby acknowledged, do grant, sell, and convey unto the City of Bryan, a Municipal Corporation of Brazos
County, Texas, with offices at 300 South Texas Avenue, Bryan, Brazos County, Texas, (Grantee), its successors
and assigns, including the City of College Station, Texas, a Water and Sanitary Sewer Easement for the purpose
of constructing and maintaining water and sanitary sewer utilities of said Cities, on, over, under and across a
certain tract of land situated in Brazos County, Texas, and described as follows:
30' WIDE WATER AND SANITARY SEWER EASEMENT BEING 2.58 ACRES
OUT OF THE BRYAN COMMERCE AND DEVELOPMENT, INC. CALLED 417.85 ACRE TRACT
VOLUME 4023, PAGE 91- J. H. JONES SURVEY, A - 26
COLLEGE STATION, BRAZOS COUNTY, TEXAS
Said Water and Sanitary Sewer Easement being more particularly described in Exhibit "A" and depicted in
Exhibit "B" which are attached hereto and incorporated as if fully set forth herein.
This is an exclusive easement and Grantor may not assign or convey any other easements or licenses to any other
party; but Grantor may continue to use and enjoy the benefit of the land within this Water and Sanitary Sewer
Easement, provided that such use and enjoyment does not interfere with the City of Bryan's, or its assigns, right of
ingress and egress over the Water and Sanitary Sewer Easement for the purpose of constructing, repairing, and
maintaining the improvements thereon. Grantor further grants to Grantee the absolute right to assign this Water
and Sanitary Sewer Easement, in whole or part, to other utility providers, including but not limited to the City of
Collage Station, without having to seek further consent from Grantor. The City of Bryan, or its assigns, may
remove any improvement, obstruction, or other hindrance, without compensation to Grantor, in the course of
construction, repair, or maintenance of the improvements to the Water and Sanitary Sewer Easement.

Grantor expressly subordinates all rights of surface use, incident to the mineral estate owned by Grantor to the
water and sanitary sewer easement uses of said surface by Grantee.

purposes aforesaid, the premises above described.

All that certain lot, tract or parcel of land being 2.58 acres situated in the J. H. JONES SURVEY,
Abstract No. 26, Brazos County, Texas, and being a part of that certain Called 417.85 acre tract as
described in deed from Cashion Family Limited Partnership, et al, to Bryan Commerce and
Development Incorporated, of record in Volume 4023, Page 91, Official Records of Brazos County,
Texas, said 2.58 acre easement being more particularly described by metes and bounds as follows:
BEGINNING at a calculated point for the westerly south comer, a 6" Fence Comer Post found for the
occupied westerly south corner of said Called 417.85 acre tract bears S 37 " 16 ' 39 " W a distance of
201.00 feet;
THENCE N 47 ° 00' 43 " W, a distance of 30.00 feet to a calculated exterior comer,
THENCE N 42 ° 59' 17 " E, a distance of 503.48 feet to a calculated exterior comer,
THENCE S 33 ° 42' 46 " E, a distance of 149.06 feet to a calculated interior comer,
THENCE S 45 " 20' 01 " E, a distance of 491.46 feet to a calculated interior comer;
THENCE N 42 ° 53' 53 " E, a distance of 801.10 feet to a calculated exterior comer;
THENCE S 48 " 06' 22 " E, a distance of 207.89 feet to a calculated interior comer;
