HomeMy WebLinkAbout2004-2771 - Ordinance - 11/23/2004ORDINANCE NO. 2771 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, PROVIDING FOR THE EXTENSION OF THE BOUNDARY LIMITS OF THE CITY OF COLLEGE STATION, ANNEXING CERTAIN TERRITORY ADJACENT TO THE PRESENT BOUNDARY LIMITS OF THE CITY OF COLLEGE STATION; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of College Station has the power by ordinance to fix the boundary limits of the City of College Station and to provide for the extension of such boundary limits and the annexation of additional territory lying adjacent to the City of College Station by the City Charter of the City of College Station, Texas, Section 7; and WHEREAS, the City Council finds that all the required notices were g~ven in the time and manner required by law, and WHEREAS, the C~ty Councd finds that the annexation wdl ensure consistent and orderly development of the annexed areas; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: SECTION 1: That the City Council hereby grants and approves the Petition for Annexation of approximately 6 843 acres as provided by V T.C.A. LOCAL GOVERNMENT CODE, Section 43.028 SECTION 2: That the tract of land described in Exhibit A and shown in B attached hereto and made a part of this ordinance for all purposes. ~s hereby added to and annexed to the C~ty of College Station, Texas SECTION 3: Should any part of this ordinance be held illegal or invalid for any reason, the holding shall not affect the remaining sections or portion of sections or provisions of this ordinance. If any part of the real property annexed in Exhibits A and B is already ~ncluded within the City Limits of the City of College Stahon or Is not within the City of College Station's jurisdiction to annex, the same ~s excluded from the territory annexed as fully as if the excluded area(s) were expressly excluded by this ordinance. SECTION 4: That, upon final passage, approval and after the effective date of this ordinance, all properly annexed shall be zoned A-O, Agricultural-Open. SECTION 5: That. upon final passage hereof and after the effective date of this ordinance, the annexed territory shall be a part of the City of College Station, Texas, and the property situated herein shall bear its pro rata portion of the taxes levied by the HCJIs II 10'04 Ordinance No. 2771 Page 2 City of College Station and the inhabitants thereof shall be entitled to all of the rights and privileges of all the citizens and shall be bound by the acts, ordinances, resoluttons, and regulations of the City of College Stat]on SECTION 6: That this ordinance shall become effective after its passage and approval on November 23~ 2004 PASSED AND APPROVED THIS THE 23a° DAY OF NOVEMBER, 2004.
