HomeMy WebLinkAbout2020-4151 - Ordinance - 02/06/2020ORDINANCE NO. 2020-4151 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS OF THE SPECIAL ELECTION, HELD ON JANUARY 28, 2020, FOR THE PURPOSE OF ELECTING CITY COUNCIL MEMBER PLACE 4 FOR AN UNEXPIRED TERM. RECITALS: 1. On December 10, 2019 the City Council of the City of College Station, Texas, ordered a Special Election be held on January 28, 2020 for the purpose of electing a City Councilmember, Place 4 for an unexpired term. 2. Notice of this election was duly published in The Eagle on January 2 and 9, 2020 and in La Voz Hispana on January 10 and 17, 2020. 3. A copy of the notice was posted on the bulletin board at City Hall on December 20, 2019. 4. This election was duly and legally held on January 28, 2020, in conformity with the election laws of the State of Texas, and the results of the election have been certified and returned by the proper judges and clerks. 5. The City Council of the City of College Station, Texas with the following members present: Mayor Karl Mooney, Councilmembers Bob Brick, John Crompton, Linda Harvell, John Nichols, and Dennis Maloney have today considered the returns of the Special Election held on January 28, 2020. 6. It appears to the City Council, and the City Council finds, that the election was in all respects lawfully held. 7. It appears to the City Council, and City Council finds, that the tabulation of the results of the election is correct. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: SECTION 1. The Special Election of January 28, 2020 was duly called, notice of the election was given in accordance with law, and the election was held in accordance with law. SECTION 2. The tabulation of votes cast in the Special Election held on January 28, 2020, for the purposes stated in Recital 1 above, a copy of which is attached to and made a part of this Ordinance is adopted as the official tabulation of the votes cast at the election, and the tabulation will be filed and recorded in the official records of the City of College Station as the official canvass of the election. SECTION 3. The official canvass of the returns of the election reflects the following: ORDINANCE NO. 2020-4151 Page 2 of 2 A. For the City Councilmember, Place 4: Candidate Number of votes received Marycruz DeLeón Morales 108 4.68% David Fujimoto 325 14.08% Elizabeth Cunha 737 31.93% Joe Guerra Jr. 1138 49.31% SECTION 4. No candidate received a majority of votes which requires a run-off election be held for the two candidates receiving the two highest number of votes cast in the special election in accordance with applicable law.
