HomeMy WebLinkAbout09-26-19-2f - Resolution - 09/26/2019 RESOLUTION NO. 09-26-19-2f A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, APPROVING CONTINUED RECEIPT OF A SHARE OF BINGO PRIZE FEE FUNDS COLLECTED AFTER JANUARY 1, 2020. WHEREAS, on May 26, 1988, the City Council of the City of College Station, Texas, adopted Ordinance No. 1757, imposing a two percent (2%) gross receipts tax on the conduct of bingo within the City of College Station; and WHEREAS, under current law, because the City of College Station imposed a gross receipts tax on the conduct of bingo as of January 1, 1993, the City is entitled to fifty percent (50%) of the fee collected on a prize awarded at a game conducted in the City, or in the event Brazos County is entitled to a share of the fee, the City is entitled to twenty-five percent (25%) of the fee collected under state law; and WHEREAS, pursuant to House Bill 914, enacted by the 86th Texas Legislature, in order to continue to receive a share of bingo prize fees after January 1, 2020, the City Council of the City of College Station, Texas, must affirmatively vote to do so and submit proof of that vote to the Texas Lottery Commission by November 1, 2019; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That the City Council hereby approves the continued receipt of a share of the bingo prize fees collected on a prize awarded at a bingo game conducted in the City of College Station. PART 2: That the City Council hereby directs the City Manager or his delegee to notify the Texas Lottery Commission of the action taken herein no later than November 1, 2019. PART 3: That the City Council further directs the City Manager or his delegee to notify each licensed authorized organization within the City’s jurisdiction of the continued imposition of the fee. PART 4: That this Resolution shall take effect immediately from and after its passage. ADOPTED this 26th day of September, 2019.
