The City Council may seek advice from its attorney regarding a pending or contemplated litigation subject or settlement offer or attorney-client privileged information. Litigation is an ongoing process and questions may arise as to a litigation tactic or settlement offer, which needs to be discussed with the City Council. Relationship to Strategic Goals: Core Services & Infrastructure Sustainable City Recommendation: None. Presented for information. Summary:Water Services got direction from City Council in April 2017 to initiate an environmental study to evaluate our three large well-field properties for their potential as Mitigation Banks. Background: Certain properties that have stream segments or wetlands can be used as Mitigation Banks, whereby environmental uplift is constructed on the property, and those improvements are sold as Credits for construction projects elsewhere that disturb or destroy those same environmental aspects on those remote sites. Staff awarded a contract to Alan Plummer and Associates to perform this environmental study on our properties, to determine what uplift is possible. The ultimate goal is to issue an RFP to existing Mitigation Bankers, who will offer proposals to pay the City for using our properties as Mitigation Banks. If the City elects to move forward, then the first task the Banker will be required to complete is to gain approval of the Mitigation Bank from the US Army Corps of Engineers. The uplift study is complete, but the next hurdle was to present this information to the local US Army Corps of Engineers office, and other related State regulatory agencies, on March 1, 2018 to get their comments. This presentation will summarize the information shared with the USACE, and discuss their reaction regarding whether our properties would likely be approved as a Mitigation Bank. Summary:The City's Charter and Fiscal and Budgetary Policies along with State law require that not less than thirty (30)days prior to the end of each fiscal year,the City Council shall designate a qualified public accountant or accountants who,as of the end of the fiscal year,shall make an independent audit of accounts and other evidences of financial transactions of the City government and shall submit the report to the City Council.Also,the City's budgetary policies require that the auditor jointly review the management letter/audit results with the City Council within 30 days of receipt by the staff. Mr.Jimmy Ingram of Ingram,Wallis &Associates will present the results of the fiscal year 2017 audit and present,along with staff,the 2017 CAFR.Mr.Ingram will also be available to answer any questions the City Council may have. Budget &Financial Summary:The reports provide a summary of the City's financial position as of September 30, 2017.
