AGENDA ITEM NO. 1: Discussion of Subdivision Regulations.
City Planner Kee and Assistant City Engineer Morgan made the presentation discussing the Subdivision
Regulations. They explained that the regulations were a part of the City's Local Code of Ordinances
and was adopted under authority of the constitution and laws of Texas and particularly references the
• state statutes (local government code) that deal with the subdivision of land. The scope and purpose of
the regulations governs all subdivisions of land to provide development control, finance improvements,
land records, a pattern of development, maintenance responsibility (owner or City), and consumer
protection. They discussed the various sections to the regulations such at ETJ (Extraterritorial
Jurisdiction), special provisions, variances, appeals process, and processing procedures.
Building permits, utilities, etc. can be held up if properties are illegally subdivided. Variances can be
granted to the Subdivision Regulations, except to landscaping. An appeal of a denial of a variance is
heard by the City Council. They explained the different processing procedures that occur during
platting of a subdivision. These are Master Development Plan, Master Preliminary Plat or Preliminary
Plat, and the Final Plat. The Master Development Plan is a conceptual plan of the property and is not
always required. Statute requires that a plat shall be acted on within 30 days after filing, or it is
automatically approved. There are different types of final plats, which include the final plat, replat,
minor plat (4 or fewer lots), amendment plat (to correct errors), and a vacating plat.
Ms. Morgan explained that there is a section referencing performance guarantees which provides for
different financial instniments that can be used in the event a developer decides to. file security in lieu of
completing construction prior to the actual filing of a final plat for record.
They also discussed minimum standards for a subdivision, installation costs (Oversize participation),
parkland dedication, and rural regulations.
