MEMBERS PRESENT: Chairperson Hawthorne and Commissioners Lane, Mariott, Hall and Smith. MEMBERS ABSENT: Commissioners Herring and Gribou. STAFF PRESENT: City Planner Kee, Staff Planner Kuenzel, Planning Technician Thomas, Planning Intern Dolev and City Engineer Pullen. AGENDA ITEM NO. 1: Approval of the minutes from the meeting of May 6, 1993. Commissioner Mariott moved to approve the minutes from the meeting of May 6, 1993 as written. Commissioner Smith seconded the motion which passed unopposed (4 - 0); Commissioner Hall was not present during the approval of minutes. • AGENDA ITEM NO. 2: Consideration of a preliminary plat and a final plat for the Devonshire Subdivision generally located on the southwest comer of Victoria Avenue and Rock Prairie Road (93-305 & 93-211) City Planner Kee presented the staff report and informed the Commission that the master plan is a single family subdivision proposed at a density of approximately 3.5 dwelling units per acre. This development is consistent with surrounding development and poses no conflict with the City's development policies or future land use plan. The next agenda item is a rezoning request for this property to be rezoned from R-5 Medium Density Apartments to R-1 Single Family Residential. At the last City Council meeting, a petition was presented by the surrounding property owners to rezone the corner 2.00 acre C-N Neighborhood Commercial piece to R-1. Staff recommended approval of the bottom portion of the master preliminary plat (including Shire Drive and blocks A & C) and table block B (including the Mustang Lane cul-de-sac) until the City initiated rezoning of the 2.00 acre tract is complete. Staff recommended approval of the final plat with the inclusion of a sidewalk along Victoria Avenue; however, staff would prefer to work with the developer on the timing of the sidewalk during phase two of the development. Commissioner Hall questioned staff as to the extension of sidewalks along both sides of Rock Prairie Road. Commissioner Lane questioned staff as to thoroughfare screening along both sides of Rock Prairie Road. City Planner Kee stated that sidewalks will be installed along both sides of Rock Prairie Road but not as a part of the Devonshire development. A development agreement currently exists for the installation of Rock Prairie Road complete with sidewalks along both sides. At the present time, the City does not have an ordinance in place to require thoroughfare screening. Commissioner Mariott moved to recommend approval of the master preliminary plat and final plat of the Devonshire Subdivision with staff recommendations. Commissioner Lane seconded the motion which passed unopposed (5 - 0). AGENDA ITEM NO. 3: Public hearing to consider a rezoning request of the Devonshire Subdivision from R-5 Medium Density Apartments to R-1 Single Family Residential (93-106) • Staff Planner Kuenzel presented the staff report and stated that this area was rezoned to R-5 in 1983 as part of the Family Tree master plan that is now developed as Westchester Park and Brandon Heights. Other developers have since purchased different portions of the area involved and through a series of replats, the area has become anode of low density, single family development. The applicant is in the process of replatting this property into single family lots. The current zoning would allow single family development, but would not preclude other residential development such as duplex or multi-family. The rezoning would provide additional assurance that only single family development will occur within the subject area. Due to the fact that the request ~s not in conflict with the land use plan nor with development policies, staff recommended approval. Sixteen surrounding property owners were notified and several responses were received in favor of the rezoning request. Chairperson Hawthorne opened the public hearing. Mike Waters of 615 Yorkshire Drive approached the Commission and expressed his support of the rezoning request. Sam Wilson of 3413 Nottingham approached the Commission and stated that he is in favor of the rezoning request. Deborah Keating, representative of the applicant, informed the Commission that the down zoning of this tract will make it more consistent with surrounding land uses. Chairperson Hawthorne closed the public hearing. • Commissioner Mariott moved to recommend approval of a rezoning request of the Devonshire Subdivision from R-5 Medium Density Apartments to R-1 Single Family Residential. Commissioner Smith seconded the motion which passed unopposed (5 - 0). AGENDA ITEM NO. 4: Public hearing to consider a conditional use permit request by Ricky Miller to allow the expansion of the existing Bullwinkle's Grill and Bar located at 1601 Texas Avenue South in the Culpepper Plaza Shopping Center. (93-711) Staff Planner Kuenzel presented the staff report and stated that the Project Review Committee reviewed the original request as well as the request for expansion last year. In order to alleviate any possible conflict with other popular tenants such as Hastings and Pancho's, staff recommended that this use be granted on the condition that parking is encouraged in the rear as much as possible. This can be accomplished by the following: (1) ensuring that the parking in the rear is well lit; (2) making the side door the main entrance and using the front door as "exit only'; and, (3) placing a directional sign on the curb cut that leads to the rear of the shopping center The Planning and Zoning Commission granted the two requests with the conditions listed above. This third request will include an additional 2000 square foot lease space to the facility. To date, the applicant has met all conditions and intends to encourage usage of the rear parking area by placing an awning over the rear door to the third lease space. The subject lease space will be used for offices and a game room. If the Commission wishes to approve this expansion, staff • would recommend that the entrance facing the main parking lot be made an "exit only" fire door, and that the rear entrance be enhanced to encourage parking in the rear. Twelve surrounding property owners were notified with one response from the owner of Bentley House Apartments. He stated that there has been a problem with beer bottles being left in their parking lot; however, for the most part, they have been good neighbors. P & Z Minutes May 20, 1993 Page Z Chairperson Hawthorne opened the public hearing. Seeing no one present to speak in favor of or in opposition to the request, he closed the public hearing. Commissioner Lane moved to approve a conditional use permit to allow the expansion of Bullwinkle's Grill and Bar located at 1601 Texas Avenue South in the Culpepper Plaza Shopping Center. Commissioner Smith seconded the motion. Commissioner Hall expressed concern of the difficulty encouraging patrons to park in the rear of the building with the current design of the shopping center. The proposed awning and "exit only" door may not be enough to address the parking problem that currently exists at the shopping center especially on Friday evenings. Commissioner Hall suggested that staff work with the applicant on more effective means of directing traffic to the rear of the shopping center. He questioned staff as to the possibility of requiring someone to stand in the parking lot and direct traffic to the rear parking area. Staff Planner Kuenzel stated that the Commission does have the authority to make that requirement and did make a similar requirement on the Charlie's nightclub conditional use permit. Chairperson Hawthorne stated that the example of the Charlie's nightclub was a matter of picking up trash. Under the current ordinance, the patrons of the nightclub or any other lease space, can park anywhere in the shopping center. The Commission approved the conditional use permit (4 - 0 - 1); Chairperson Hawthorne abstained. AGENDA ITEM NO. 5: Consideration of a final plat for the Plantation Wood Subdivision • located in the College Station E.T.J. (93-210) City Engineer Pullen presented the final plat of Plantation Wood Subdivision located in the E.T.J. along south Dowling road. The subdivision is a total of 20 acres and the applicant is proposing to reconfigure the five existing lots into four. The final plat is in compliance with the City's development policies and staff recommended approval. Commissioner Mariott moved to recommend approval of the final plat of the Plantation Wood Subdivision. Commissioner Lane seconded the motion which passed unopposed (5 - 0). AGENDA ITEM NO. 6: Consideration of a preliminary plat for the High Ridge Subdivision located immediately north of the Gateway Park Subdivision along the east side of the East Bypass. (93-306) City Engineer Pullen presented the staff report and recommended approval of the preliminary plat with the following: with regard to the continuation of the public alley in the rear of the property, staff concurs with the impact studies with the condition that a cul-de-sac or other acceptable termination of the existing public alley be made at the rear of the Cinemark property. Staff also recommends a combined driveway opening between lots 1 and 2. Commissioner Hall expressed concern that the Commission should view the alley as a street and consider continuing the street through lots 1 and 2 and installing a cul-de-sac at the end of lot 2. Once the frontage roads are designated as one way, the use of and the need for the alley will increase. City Engineer Pullen stated that staff has looked at this problem since the Sam's development. The impact studies for the Cinemark tract showed that the capacity of the alley is adequate for that development. The proposed arrangement of this dealership will have access from the frontage road and there is no desire to have rear access due to security concerns. P & Z Minutes May ZU, 1993 Page 3 Owner of the property John Hamilton informed the Commission that the alley does not have any bearing on the subject property. The security concern of the alley is important due to the location of the repair vehicles and new vehicles being stored in the rear of the property where the alley would be extended. Commissioner Hall moved to recommend approval of the preliminary plat of the High Ridge Subdivision with staff recommendations. Commissioner Mariott seconded the motion which passed unopposed (5 - 0). AGENDA ITEM NO. 7: Other business. There was no other business. AGENDA ITEM NO. 8: Adjourn. Commissioner Mariott moved to adjourn the meeting of the Planning and Zoning Commission. Commissioner Lane seconded the motion which passed unopposed (5 - 0).
