MEMBERS PRESENT: Commissioners Smith, Mariott, Gribou and Herring. MEMBERS ABSENT: Chairperson Hawthorne and Commissioners Hall and Lane. STAFF PRESENT: City Planner Kec, Planning Technician Thomas, City Engineer Pullen, Staff Planner Kuenzel and Development Services Director Callaway. AGENDA ITEM NO. 1: Approval of minutes from the meeting of May 20, 1993. Commissioner Smith moved to approve the minutes from the meeting of May 20, 1993 as written. Commissioner Gribou seconded the motion which passed unopposed (4 - 0). AGENDA ITEM NO. 2: Public hearing to consider a city initiated rezoning of 2.00 acres located on the southeast corner of Victoria Avenue and Rock Prairie Road, lot 1, block 1 of the Westchester i Park Phase II Subdivision, from GN Neighborhood Commercial to R-1 Single Family Residential (93-107) Staff Planner Kuenzel presented the staff report and recommended approval of the rezoning due to the tact that the request is not in conl7ict with the land use plan nor with development policies. This rezoning request is a result of a petition that was presented to City Council in an effort to request that the City rezone the property to residential. This area was rezoned to R-5 in 1983 as a part of the Family Tree master plan for the area that is now developed as Westchester Park and Brandon Heights. The Family Tree development was never completed and other developers have since purchased different portions of the area involved. Through a series of replats, the area has become a node of low density, single family development. Ten surrounding property owners were notified of the request; several calls were received in favor of the rezoning request and none in opposition. Commissioner Marion opened the public hearing. Judith Cook of 3501 Nottingham approached the Commission as a representative of the Williams Court and Williams Estates Subdivisions. She stated that homeowners in the surrounding area are very concerned with commercial zoning directly across from an elementary school. The increased traffic as well as the sell of alcoholic beverages in the current zoning classification is not acceptable next to a school. All oC the public schools in College Station arc surrounded by residential development. There is commercial zoning along Rock Prairie Road and Wellborn Road that is available; commercial zoning of the subject property is not needed. The petition submitted to the City Council contained 76 signatures and there are many other property owners that have indicated they would also like to sign the petition. Mike Waters of 615 Yorkshire approached the Commission and stated that he is in favor of the proposed rezoning for many of the same reasons expressed by Ms. Cook. The rezoning to single family residential is essential in maintaining the residential character of the neighborhood. A commercial business that increases traffic, sells alcohol and allows children to hang around outside is not desirable in this neighborhood. Patti Wcndlandt of G02 North Graham informed the Commission that she is in favor of the proposed • rezoning and reminded the Commissioners that there is also a junior high school that is in close proximity to the subject property. Commissioner Mariolt closed the public hearing. Commission Gribou moved to recommend approval of the city initiated rezoning of 2.00 acres located on the southeast corner of Victoria Avenue and Rock Prairie Road, lot 1, block 1 of the Westchester Park Phase II Subdivision lrom C-N Neighborhood Commercial to R-1 Single Family Residential. Commissioner Herring seconded the motion which passed unopposed (4 - 0). AGENDA ITEM NO. 3: Consideration of a final plat for the Edelweiss Estates Phase II Subdivision. (93-212) City Engineer Pullen presented the staff report and recommended approval of the final plat. The applicant was nolificd that the City Graham Road sewer project will hopefully coordinate with this development. If it does not, the applicant will have to work with the City to find an alternate °temporary" solution for the sewer service to these lots. Oversized participation in Victoria Avenue is a part of a development agreement between the City Council and the applicant approved on January 18, 1993. Sidewalks are required on one side of Aster Drive between Nottingham Drive and Schaffer Road and along one side of Nottingham Drive. The upgrade and extension of Victoria Avenue will take place with phase three ol~ this development. Commissioner Herring moved to recommend approval of the lnal plat for the Edelweiss Estates Phase II Subdivision with staff recommendations. Commissioner Gribou seconded the motion which passed unopposed (4 - 0). • AGENDA ITEM NO. 4: Consideration of a final plat for the Elm Crest Subdivision. (93-213) City Engineer Pullen presented the staff report and recommended approval with the presubmission comments. The developer may request oversize participation on Mint Avenue and sidewalks will be required along both sides of Mint Avenue. The final plat as presented conforms to the preliminary plat approved by City Council on April 8, 1993. Commissioner Herring moved to recommend approval of the final plat for the Elm Crest Subdivision with stall recommendations. Commissioner Smith seconded the motion which passed unopposed (3 - I - 0); Commissioner Marion abstained from voting. AGENDA ITEM NO. 5: Other business. There was no other business. AGENDA ITEM NO. 6: Adjourn. Commissioner Herring moved to adjourn the meeting of the Planning and Zoning Commission.
