MINUTES
Planning and Zoning Commission Meeting
4111 September 29, 1975
7:00 P.M.
MEMBERS PRESENT: Chairman Longley; Commissioners Boyett, Austin, Miller, Stevenson;
City Planner Mayo; Planning Assistant Longley
MEMBERS ABSENT: Commissioners Mathewson, Stover
VISITORS PRESENT: See guest register.
Agenda Item No. 1 -- Reconsideration of a replat of the resubdivision of Lots 24 and
25, Block 5, University Oaks, Section Two. City Planner Mayo said that he and City
Engineer Ash had compared the two proposals and would recommend the plan showing the
unit fourteen inches over the front setback line because it would allow better drive-
way access onto Dominik. He said this unit would violate the front setback line by
fourteen inches and the rear setback line by five feet. Mayo pointed out that Mr.
Cruz must apply for a building permit, have it refused on those grounds, and appeal
to the Zoning Board of Adjustment for a variance. Commissioner Boyett moved to approve
the replat of Lots 24 and 25 as shown. Commisioner Austin seconded. The motion passed
unanimously.
Commissioner Boyett moved to recommend to the Zoning Board of Adjustment that they
favorably consider the proposed request showing the front corner of the unit 23'-10" off
the Donomik right-of-way and 20'-0" off the rear property line adjacent to College Hills-
ill' Woodlands; in other words, the variance needed would be 5'-0" on the rear setback line

and l'-2" on the front setback line. This reason would be part of the recommendation:
due to the unique nature of the lot, it being long and tapered to a zero width at the
east end, and in an effort to utilize this lot to the best of its ability, and at the
same time still grantingas much aspossible screeningand separation distance to those

people in College Hills Woodlands. Commissioner Miller seconded. The motion passed
unanimously.
Agenda Item No. 2 -- Other business. There was none.
Agenda Item No. 3 -- Adjourn. Commissioner Boyett moved to adjourn. Commissioner
Stevenson seconded. The motion passed unanimously.
