To: November 23,2009 Workshop Agenda Item No. 2 UPDATE: Re-write of Local Animal Control Ordinance Glenn Brown, City Manager From: Jeff Capps, Interim Chief of Police Agenda Caption: Presentation, possible action, and discussion regarding the re-write of the City of College Stations Ordinance as it relates to Animal Control. Recommendation(s): It is recommended that the Council receives the recommended changes as developed by the subcommittee and discusses the content and the process for addressing the elements presented. Options include setting additional workshops and opportunities for public input prior to adopting the City of College Station Code of Ordinance Chapter 2 - Animal Control. Summary: Approximately 2 years ago a sub-committee of the Intergovernmental Committee (IGC) was formed to review and look at the Animal Control Ordinances and policies throughout Brazos County. The sub-committee is chaired by City of College Station Councilman James Massey. The sub-committee has developed a proposed re-write draft of the City of College Station Code of Ordinance Chapter 2 - Animal Control. Recommendation(s): Staff recommends that the project scope be reduced from a 6 lane divided section to a 4 lane divided section that will fit within the existing right-of-way. Summary: Mark Smith met with TxDOT staff and Dale Picha from the City of Bryan on September 3oth. TxDOT expressed the desire to move this project ahead and is looking for support from the two cities. This is the project that Senator Ogden was promoting a few months ago. Bryan and College Station were each asked to contribute 2.5 million to the effort with a promise that the State would fund the remaining cost. TxDOT completed a schematic design of the 6 lane option as well as an environmental study. The State's estimate of the ROW cost was estimated to be about $12 million. The total project cost was estimated to be about $24 million. TxDOT does not have adequate funding available to make this project happen and the District Office has been tasked with finding a way to make the project happen. TxDOT staff has suggested two options. One option is to reduce the project scope to a 4 lane divided section that would fit within the existing ROW, termed the shoehorn option. The other option is to keep the current 6 lane divided with wide sidewalks and find a way to reduce the ROW cost by asking for ROW dedications from the two cities, the University and The Adam Corporation. In addition, College Station could reduce the ROW cost by $3.5 million by covering the cost of a major waterline relocation made necessary by the widening. All of this in addition to the 2.5 million previously requested. The current 6 lane design complies with our Thoroughfare Plan and includes wide walks and streetscape. TxDOT will not abandon this project scope without the consent of the City of College Station. The project was originally planned to be a 4 lane divided section but was widened to a 6 lane section to comply with the revised thoroughfare plan. Based on projected traffic volumes and taking into consideration that SH 30, which parallels FM 60, will be ultimately widened to a 4 lane divided section, staff feels that the 4 lane section will be adequate. This item was discussed by the Council Transportation Committee on November 17~~. The CTC recommended pursuing the "shoehorn" option. Budget & Financial Summary: The 4 .lane option has an estimated cost of 7 to 8 million dollars. An existing federal earmark contributes 4 million and TxDOT is asking the Cities of Bryan and College Station to contribute 1 million each to the project with TxDOT making up the remaining costs.
