During the upco,, * g August 14, 2001 P,,ks and !ecreation Advisory I o.ird Workshop
Meeting, a presentation will be ,de regarding the review and update of the ark Land
Dedication Ordance. This review is required every three years. The review is also part
of the City Co ,,cirs Strategic Plan(Vision Statement#4, Strategy#4c).
A portion of the presentation will cover the existing ord* nce and its provisions. The
other portion will * ,volve a short discussion of three neighoorhood parks accepted in the
past few years. The objective is to receive input from the Board to beg' the ordinance
review process.
The Board may wish to visit the three parks involved in the discussion before the
meeting. The names an.I directions to each site are listed below. These sites will be used
as examples for a discussion of acceptance perimeters that the Board may wish to
consider as part of the review orocess.

BE IT ORDA I D BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,TEXAS:
PART 1: That "Chapter 9 Subdivisions, Section 10, Requirements for Park Land Dedication", of
the Code of Ordinances of the City of College Station, Texas, be replaced with that set
out in Exhibit"A",attached hereto and made a part of this ordinance for all purposes.
PART 2: That if any provisions of any section of this ordinance shall be held to be void or uncon-
stitutional,such holding shall in no way effect the validity of the remaining provisions or
sections of this ordinance,which shall remain in 11 force and effect.
PART 3: That ny person,firm, or corporation violating any of the provisions of this chapter shall
be deemed guilty of a m sdeme ior, tin upon conviction thereof shyI/ be punishable by a
fine of not less than Twenty-five D•liars($2500)nor more than Two Thousand Dollars
($2,000.00). Each 1:ay such violation shall continue or be permitted tt continue, shall be
denied a separate offense. Said Ordinance, being a penal or47.ance, becomes effective
six(6)months aft, its publication in the newspaper, as provided by Section 35 of the
Charter of the City of College Station.

10-A, Pu
10-A.1 This section is adopted to provide recreational areas in the form of
neighborhood paxks as a function of subdivision and site development in the
City of College Station. This section is enacted in accordance with the home
rL le powers of the City of College Station, &anted der the Texas
Constitution, and the statutes of the State of Texas, including, but not by way
of limitation, Texas Local ov't Code Chapter 212 (Vernon 1988; Vernon
ups. 1999). It is hereby declared by the City Council that recreational areas
t e form of neighborhood parks are necessary and in the public welfare,
and that the only adequate procedure to providc for st; e is by integrating
such a requirement M'S the procedure for pla g and developing property
or subdivisions in the city whether such development consists ot new con-
struction on vacant land or rebuilding and re odeling of structures on
existm' g residential property.
10-A.2 Neighborhood parks axe those parks providing for a variety of outdoor
recreational opportunities and located wn convenient distances from a
..jority of the residences to be served thereby. The park zones established
Iy the Parks and Recreation Department d ShOW11 on the official Parks d
Recreation p for the City.of College Station shall be pr a facie 0-0°f-that
any park located therein is within such a conyenient distance tvrom any
residence located therein. The pri .ry cost of neighborhood parks should be

prox ity of their propeity to such parks, shall *-e the prh, gry beneficiaries
of such facilities.
Therefore, the folks g re suirements are adopted to effect the puruses stated
above and shall apply to any 'and to be used for residential purposes:
I 0-B General Reeuirement
Dee ications shall cover both land and •evelopmnt ecosts for neighborhood park land
for types of residential development.
I 0- -1 Land Dedication
\Whenever a fmal plat is flied of record with the County Clerk of Br 'OS
CO ty for development of a residential area in accordance with the pia g
and zoning regulations of the City, such plat shall contain a clear fee simple
dedication of an area of land to the City for park purposes. For ski& fa, ly
developments this area shall be equal to one 0) acre for each one hundred
anU one (101) proposed dwelling its. For duplex and other multi-fa ely
development this area shall be equal to one (1) acre for each one hundred and
I (134) ?proposed dwell* units. For methodology refer to
Appendix 1 attar/led herein and incorporated and made a part or this
ordinance for 11 purposes.
Any proposed plat subi Ited to the City for approval shall show the area
pro•e sed to be dedicated under this section. The required land dedication of
this subsectisn may be met by a pannent of money in lieu of land when
per Ited or required by the other provisions of this section.
In the event a plat is not required this dedication shall Ix met prior to the
issuance 01 a build* g pe it.
013.2 Fee in Lieu of Land
A land owner responsible for dedication der this section may elect to meet
LI e requirements of 10-it.1. in whole or in part by a cash payment in of of
land, m the amount set forth below, Before ,king this election, the land
must obtain amroval for the cash payment m lieu of land from the
• & Zoning. Co iission pursuant tc the plat approval procedures set
ILL in apter 9, Section 6. Such payment m lieu of land shall be ...de at or
prior to the thne filing the final plat for record at the Courthouse or prior to
the issuance of a buildm° g permit where a plat is not required.
The fee in lieu of land dedication requirement shall be met by a payment of a
fee set from time to time by resolution by the Citv Co 61, it to
acquire neighborhood park land. Unless changed hi the City Co cii, such
per-C cre price shall be comyuted on the basis of one hundred and forty-eight
dollars ($148.00) per dweing unit for single family development and one
hundred and twelve dollars ($112.00)per dwelling mut for duplex and mult

shall be reviewed and approved by the Parks Board. All improvements shall
either be financially guaranteed or accepted by the City prior t* the filing of a
plat in the case of platted developments or prior to issuance of certificates of
occupancy hi the event that plattmg s not required. The process of financial
guarantee shall be the same as that found in section 7 of the Subdivision
Regulations and shall be used whether a plat is required or not. Once
impKovements are accepted by the City the aeveioper shall deed the property
and provements to the City.
10-B.5 In instances where an area of less than five (5) acres is reqpired to be
dedicated, -tbe City shall have the right to accept the iedication To r approval
on the piat, or to refuse same, after consideration of the
reco endation of the l ng and Zoning Co issjon and the Parks an*
Recreation toard. The City shaft have the right to req. e payment of cash in
lieu of land in the amount provided above, if it dete mes that sufficient park
area is already in-the public 0 I in the area of the proposed development,
or if the recreation potentig for that zone WOUld be better served by
expanding or proving existmg parks.
10-1.6 The dedication required by this section shall be lie by filing of the final

0-EA The !ark and Ot n Space Plan is intended to. provide the Colle,ae Station
Parks and Recreation Advisory Boaxd with a guide upon which to bi- e -future
ecisions. tecause of the need to consider specific characteristics in the site
selection process, the park locations indicated on the Plan, are general. The
actual locations, size ,s and nmnber of parks will be determined vkihen
development occurs. The Pkn will also be used to locate desirable park sites
before development occurs, and those sites may be purchased by the City or
received as donations.
10-E.2 Park Zones are established by the City's Comprehensive Plan and are
corifigured to iridicate service areas for neighborhood parks. Zope
bouridarjes are established that follow key topographic features such as --jor
thoroug ;;.,„res, strea 1 and city limit lines.
