AGENDA ITEM NO. 4: Presentation, possible action, and discussion to consider proposed signage in the Wolf Pen Creek District generally located at 2400 Earl Rudder Freeway South. # WPC2017-000001 Staff Planner Thomas gave the Board an overview of the Wolf Pen Creek Overlay District and presented the staff report. She told the Board that the applicant is proposing to replace the freestanding sign for Grand Station Entertainment. The proposed sign will be placed in the same general location of the existing sign and the setback from the right of-way is approximately 120 feet. The sign will be approximately 25.6 feet tall with natural stone foundation and a tan monument to hold the signage. She ended her staff report by saying the Page 2 of 2 proposal meets all other required sign regulations per the Unified Development Ordinance sign section and the structural requirements of the building code. Property owner Mike Logan and Mike Haggerty with Wakefield Signs were in attendance to answer any questions of the Board. There was general discussion amongst the Board. Board member McKinney motioned to approve the request as presented. Board Member Natsios seconded the motion, which passed (6-1). Board member McGrail voting against the motion to approve. Design Review Board November 10, 2017 Page 2 of 3 Design Review Board November 10, 2017 Page 3 of 3 DESIGN REVIEW BOARD ROLE AND RESPONSIBILITY: The Unified Development Ordinance (UDO) Appendix A Section 2.5.A states that the Design Review Board is established to enhance “the City's ability to review sign, building, and site design issues, including architectural issues as specified in this UDO, by bringing expertise from the community to bear on these issues in designated design districts.” As part of this purpose, UDO Appendix A, Section 7.7.H Appeals grants the Design Review Board with the power and duty to authorize a waiver to the Section 7.7 Buffer Requirement when: “such standards or variance will not be contrary to the public interest where, owing to unique and special conditions not normally found in like areas, a strict enforcement of the provisions of the ordinance by the Administrator would result in unnecessary hardship, and so that the spirit of this Section shall be observed and substantial justice done.” Based on this section, the Design Review Board can act upon the proposed request in one of the following ways: 1) Approve the request as proposed 2) Approve the request with conditions 3) Deny the request ITEM SUMMARY: The applicant is requesting a waiver to Buffer Requirements due to the property’s unique physical characteristics. On its northwestern boundary, the subject property abuts a 10-foot wide residential common area zoned R Rural that separates the property from the public right-of-way of Jeanne Drive. Due to this abutment to a property zoned for single-family purpose, the subject property is required to install a buffer that consists of 20-foot buffer yard and a fence. In addition, the SC Suburban Commercial zoning district requires the subject property to double the buffer planting from those found in other commercial districts and install a wall between any parking area and the impacted property line. If the property had abutted the Right-of-Way rather than this common area, the buffer requirements would not have applied. Cityview Southwest has received approval on a Site Plan and a Landscape Plan that does not contain a waiver to the buffer standards on its northwestern boundary. However, the applicant’s request is for the Design Review Board to consider waiving the Buffer Requirements on the northwester boundary in lieu of allowing the development to meet streetscape requirements found in Section 7.6 Landscaping and Tree Protection so it may revise these plans. A proposed Landscape Plan showing how such standards would apply is included with this report.
