AN ORDINANCE MAKING CERTAIN AFFIRMATIVE FINDINGS AND VACATING
AND ABANDONING THE 70 FOOT WIDE STREET AND PUBLIC UTILITY
EASEMENT, SAID EASEMENT LYING WITHIN LOT 1A, BLOCK 1, OF THE
SCIENCE PARK SUBDIVISION, ACCORDING TO THE RE-PLAT RECORDED IN
VOLUME 14160, PAGE 1 OF THE OFFICIAL RECORDS OF BRAZOS COUNTY,
TEXAS.
WHEREAS,the City of College Station, Texas, has received an application for the vacation and
abandonment of the 70 foot wide street and public utility easement, said easement lying within Lot
1A, Block 1, of the Science Park Subdivision, according to the re-plat recorded in Volume 14160,
Page 1, of the Official Records of Brazos County, Texas, as described in Exhibit "A", attached
hereto (such easement hereinafter referred to as the "Easement"); and
WHEREAS, in order for the Easement to be vacated and abandoned by the City Council of the
City of College Station, Texas, the City Council must make certain affirmative findings; now
therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS:
PART 1: That after opening and closing a public hearing, the City Council finds the
following pertaining to the vacating and abandoning of the Easement described in
Exhibit "A" attached hereto and made a part of this ordinance for all purposes.
1. Abandonment of the Easement will not result in property that does not have
access to public roadways or utilities.
2. There is no public need or use for the Easement.
3. There is no anticipated future public need or use for the Easement.
4. Abandonment of the Easement will not impact access for all public utilities
to serve current and future customers.
PART 2: That the Easement as described in Exhibit "A" be abandoned and vacated by the
City.

Being a strip of land seventy(70)feet wide and containing 2.097 acres(called),more or less,described in a
deed to the City of College Station,recorded in Volume 555,Page 503,Deed Records of Brazos County,Texas,
(D.R,B.C.,Tx.)being over,across, and upon a portion of Lot 1,Block 1,and a portion of a called 5.66 acre
Common Area,Block 1,of The Science Park Subdivision,situated in the City of College Station,Brazos County,
Texas,in the Morgan Rector Survey,A-46,described in a deed to OGC College Station Park LP,recorded in
Volume 14160,Page 01,Official Records of Brazos County,Texas,(0.R.B.C.,Tx.)and being more particularly
described as follows:
BEGINNING at a 1/2-inch capped iron rod,stamped"KLING"for the north corner of said Lot 1,Block 1,same
being the west corner of Lot 9,Block 1,Raintree Subdivision,Section 3,recorded in Volume 419,Page 41,
(D.R.B.C.,Tx),in the southeast line of a 29.348 acre tract of land described as Lot 1,Block 1,A.&M Church of
Christ,recorded in Volume 8707, Page 51, Official Records of Brazos County,Texas, (O.R.B.C.,TX.)for the
north corner of herein described tract;
THENCE South 47 Degrees 23 Minutes 19 Seconds East,with the southwest line of said Raintree Subdivision
Section Three, 1305.13 feet to a 1/2-inch capped iron rod, stamped"KLING" for the east corner of said
Common Area,same being the south corner of said Raintree Subdivision,Section Three,in the northwest line
of Block 3,Carter's Crossing Subdivision,Phase Two,recorded in Volume 11351,Page 129,(O.R.B.C.,Tx.)for
the east corner of herein described tract;
THENCE South 42 Degrees 37 Minutes 52 Seconds West,with the southeast line of said Common Area to the
south corner of the herein described tract.For reference,a 1/2-inch capped iron rod,stamped"KLING",bear
South 42 Degrees 37 Minutes 38 Seconds West,1046.28 feet;
THENCE North 47 Degrees 23 Minutes 19 Seconds West,leaving said southeast line and being parallel with
the northeast line of said Lot 1,Block 1,1305.04 feet to the common line between said Lot 1,Block 1 and said
29.348 acre tract,for the west corner of the herein described tract.For reference,a 1/2-inch capped iron rod
stamped"KLING",bears South 42 Degrees 33 Minutes 35 Seconds West,1225.66 feet;
THENCE North 42 Degrees 33 Minutes 35 Seconds East,with said common line;70.00 feet,to the PLACE OF
BEGINNING and occupying 2.097 acres of land,more or less.
Bearings are based on the NAD 83 Texas State Plane Coordinate System,Central Zone(4203)as obtained
by GPS observations.
Reference is hereby made to a separate survey plat bearing even date herewith.
