HomeMy WebLinkAbout2017-3929 - Ordinance - 09/11/2017 ORDINANCE NO. 2017-3929 AN ORDINANCE AMENDING APPENDIX A, "UNIFIED DEVELOPMENT ORDINANCE," SECTION 4.2, "OFFICIAL ZONING MAP," OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION,TEXAS,BY CHANGING THE ZONING DISTRICT BOUNDARIES FOR APPROXIMATELY 0.6 ACRES FROM GS GENERAL SUBURBAN TO PDD PLANNED DEVELOPMENT DISTRICT BEING 100 AND 200 FAIRVIEW, COLLEGE STATION, BRAZOS COUNTY, TEXAS, RECORDED IN VOLUME 38, PAGE 602 OF THE DEED RECORDS OF BRAZOS COUNTY, TEXAS AS FURTHER DESCRIBED BELOW; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That Appendix A, "Unified Development Ordinance," Section 4.2, "Official Zoning Map," of the Code of Ordinances of the City of College Station, Texas,be amended as set out in Exhibit "A" and Exhibit "B", and as shown graphically in Exhibit "C" and Exhibit"D", attached hereto and made a part of this ordinance for all purposes. PART 2: That if any provisions of any section of this ordinance shall be held to be void or unconstitutional, such holding shall in no way effect the validity of the remaining provisions or sections of this ordinance, which shall remain in full force and effect. PART 3: That any person, firm, or corporation violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars ($25.00) nor more than Two Thousand Dollars ($2,000.00). Each day such violation shall continue or be permitted to continue, shall be deemed a separate offense. PART 4: Said Ordinance, being a penal ordinance,becomes effective ten(10) days after its date of passage by the City Council, as provided by Section 35 of the Charter of the City of College Station. Setback — UDO Section 12-5.4 "Non -Residential Dimensional Standards": The GC General Commercial zoning district is the base district for uses for the development which requires a minimum 25 -foot setback. The applicant is requesting that the front setback be reduced from 25 feet to ten (10) feet. 2. Use — UDO Section 12-6.3 "Types of Use": Remove Drive-Thru as a permitted use. 3. Community Benefits • Redevelopment of an underperforming lot for the relocation of Aggieland Outfitters, who wish to maintain a presence in Southgate with the upcoming TxDOT construction; • Residential architectural styles that complement the historical nature of the Southside neighborhoods such as pitched roofs, extended eaves, porches, and wide plank building materials; • 15 -foot landscaped buffer with either an 8 -foot masonry wall or decorative fence (homeowner's choice) for the property lines that abut residential property; • Decorative fencing to screen the parking lot and commercial activities from Fairview; • Eliminating the requirement for a commercial dumpster in lieu of recycling collection; • Unless otherwise determined by TxDOT, a single, shared access from George Bush Drive; and • A neighborhood identification sign at the front of the property as an entrance to the historic Southside neighborhood.
