The Building and Standards Commission voted unanimously(5-0)to declare the structure
at the above referenced address unsafe at their meeting on 29 September 2003. The
Commission also ordered the structure demolished and all debris removed within 90
days. I have included a copy of the Commission's order for your convenience.

NOTICE OF PUBLIC HEARING
TO ALL OWNERS, LIENHOLDERS, AND MORTGAGEES: NOTICE IS
HEREBY GIVEN IN ACCORDANCE WITH SECTION 214 OF THE TEXAS
LOCAL GOVERNMENT CODE THAT THE CITY OF COLLEGE STATION
BUILDING AND STANDARDS COMMISSION WILL HOLD A PUBLIC
HEARING ON MONDAY, 29 SEPTEMBER 2003, AT 6:00 P.M., COUNCIL
CHAMBERS, CITY HALL, 1101 TEXAS AVENUE, COLLEGE STATION,
TEXAS 77840 TO DETERMINE:
WHETHER A STRUCTURE IS IN COMPLIANCE WITH THE CITY'S
ADOPTED PROPERTY MAINTENANCE CODE FOR THE CONTINUED
USE.
Legal Description of Property:
Being a 1.40 acre tract or parcel of land lying and being situated in the ROBERT
STEVENSON SURVEY, Abstract No. 54, Brazos County, Texas and being part of the 4
acre tract of land described in a deed dated November 4, 1939, from P.L. Barron, Sr. to
Napoleon Burrell, recorded in Volume 101, page 430, Deed Records of Brazos County,
Texas and being more particularly described as follows:
BEGINNING at an iron rod set at the fence corner found marking the north corner of the
beforementioned 4 acre tract in the southeast right-of-way line of Barron Road, a county
road, as the said road is now defined by existing fences;
THENCE S 45° 00' 00" E along the northeast line of the beforementioned 4 acre tract for
a distance of 544.50 feet to a point for corner, same being the north corner of a 1.58 acre
tract being out of the said 4 acre tract;
THENCE S 42° 42.5' W along the northwest line of the beforementioned 1.58 acre tract
for a distance of 112.00 feet to an iron rod set for the corner, same being the east corner
of a 1.00 acre tract being out of the beforementioned 4 acre tract;
THENCE N 45° 00.0' W along the northeast line of the beforementioned 1.00 acre tract
for a distance of 544.50 feet to an iron rod set for corner in the beforementioned fence
and southeast right-of-way line of Barron Cut Off Road; said iron rod corner also being
the north corner of the said 1.00 acre tract;
THENCE N 42° 42.5' E along the beforementioned fence and southeast right-of-way line
of Barron Road, same being the northwest line of the beforementioned 4 acre tract, for a
distance of 112.00 feet to a PLACE OF BEGINNING, containing 1.40 acres of land,
more or less.

Code Violations:
1. Sanitary facilities (sinks, lavatories,tubs, showers, and water closets) are not
connected to an operational water source, in violation of the 2000 International
Property Maintenance Code.
2. Required plumbing fixtures are not connected to an operational water heater capable
of providing adequate hot water, in violation of the 2000 International Property
Maintenance Code.
3. Electrical outlets, fixtures, and receptacles are not properly connected to a source of
electrical power, in violation of the 2000 International Property Maintenance Code.
4. Windows and doors are damaged or missing so that the building envelope is not
weather tight, in violation of the 2000 International Property Maintenance Code.
5. The structure has not been maintained in a sanitary condition, in violation of the 2000
International Property Maintenance Code.
6. The structure does not have adequate heating facilities, in violation of the 2000
International Property Maintenance Code.
7. The cooking equipment is not connected to a power source, in violation of the 2000
International Property Maintenance Code.
8. The structure does not have operable smoke detectors, in violation of the 2000
International Property Maintenance Code.
9. Structural member have deteriorated and are not capable of supporting imposed loads,
in violation of the 2000 International Property Maintenance Code.
Action to be Recommended to the Commission by the Building Official or Fire Marshal:
That the structure be declared unsafe, substandard and a hazard to the public health,
safety and welfare. That the building should be secured.
Description of the hearing:
The Building and Standards Commission Chairperson will conduct the public hearing.
The Commission shall provide each party an opportunity to present evidence and cross-
examine witnesses at the hearing. Public comment will also be accepted at the meeting.
All owners, lienholders, or mortgagees will be required to submit at the hearing proof of
the scope of any work that may be required to comply with the ordinance and the time it
will take to reasonably perform the work.
If the owner fails to comply with the Commission's order, the City of College Station
may perform the work required to abate any violations. Please direct any questions to the
College Station Building Division at (979) 764-3741.
