RE: Moving house from 1313 Peale St. , Bryan to College Station
Mr. Foress Johnson called the City of College Station to have a
house inspected to see if he could move it into the City. Bobby
Williams and Wes Castolenia made the inspection on Friday, April
22, 1988.
I refused to issue a permit to move the house to Thompson Street.
I will have pictures at the meeting. The house was condemned by
the City of Bryan , then the City of Bryan issued a permit for the
house but no work was done. Now they want to move it to College
Station.

Dear Sir:
On Tuesday, May 3, 1988 the Structural Standards Board/Building
Code Board of Adjustments met to consider a request to move a
house from 1313 Peale Street in Bryan to a lot at 408 Thompson in
College Station.
The Board voted to deny the request , but stated the house could
be moved if it met the Structural Standard Code of the City of
College Station at the time that a permit is issued.
All structural elements of the house, all electrical and plumbing
must meet Code before a permit is issued.
All other requirements of the Code may be done after the house is
moved.
See attached Ordinance #1128 and Ordinance #1733.

Dear Mr. Johnson:
I have received your letter of May 13, 1988. As you are aware,
the Structural Standards Board/Building Code Board of Adjustment
Appeals has denied your application. The Board no longer has
jurisdiction of that application. I will use your initial
letter/application and attach this letter as your new applica-
tion.
I have contacted the Chairman of the Board. He has set the meet-
ing of the Board for consideration of this application on Friday,
May 20, 1988, at 4:00 p.m. in the City Council chambers at City
Hall . If you are unable to attend a Board meeting at this time,
please let me know as soon as possible so that I can contact the
Board and notify the Chairman that the meeting will need to be
reset at another date.

Dear Mr . Johnson;
To follow up our phone conversation on Friday, March 2nd, I
wanted to reiterate what was said so that there is no
misunderstanding.
Before the Community Development Office became involved in
reviewing your application for the house at 408 Thompson,
the Building Dept . had started condemnation procedures on
the property. According to Mr . Perry, (Head Building
Official ) , plans have been made to bring the issue before
the Structures Board .
I can sympathize with your situation but it would be
counter-productive to proceed with rehab plans through the
Community Development Office until the issues pending with
the Building Dept. are resolved . After all, our office uses
inspections made by the Building Dept . in deciding whether
or not an investment in the property is worthwhile . As of
today, the Building Dept. is telling us that the property
needs to be condemned.
Please call me with any questions you may encounter or when
your case has been resolved with the Building Dept . and I
will be glad to continue review of your application at that
time . Be advised, however, that to bring a building of that
size up to the standards we require for our program, the
total project cost will probably be in the range of twelve
(12) to eighteen (18 ) thousand and the part contributed by
the city would be limited to 7500 . 00 . That is substantially
higher than you initially planned on spending. Let me know
what happens, and in the meantime we will keep your
application on file .

Dear Sir:
I have been informed by the Rev. James E. Williams that I have approximately two
weeks to move the house from the church property. I have talked to the carpenter,
electrician, and plumber and they have informed me that the work cannot be performed
on the house until after it is moved without great difficulty. I was asked at the meeting
what I could put up as a bond. I would be willing to ask for bids on the work and put
up a cash bond for that amount, which would be repaid to me as the work is completed
and the house meets the necessary sections of the building code. Please bring this
proposal in front of the Board of Adjustments for their consideration. If you have any
questions, feel free to call me at 693-5926. Thank you for your time.

Dear Sir:
I received your letter on March 14, and would like you to know that we are not neglecting
this house. We have spent over $6,000 on this house and we are planning to finish up
this project as soon as possible. We did know that we had a time limit on finishing the
house; the house had passed all code inspections before moving it into College Station.
We were prepared to bring the house up to code for Electrical and Plumbing over
Spring Break but we now cannot proceed until you release the permits for Structural
Standards.
We would appreciate if you would release the permits for Structural Standards so that
we can proceed working on this project; we would like to resolve this as soon as possible.

Dear Mr . Perry:
Thank you for your recent letter regarding my property at 303
Cooner ( front duplex) and 307 Cooner .
These properties have not been lived in for over 10 years and
have been used for storage related to my Scholar ' s Inn
Apartments .
Pending lender approval , which has already been provisionally
granted , it is my plan to demolish these two buildings and
replace their current functions with a new storage building on
the back of the 188 ft . deep lot at 307 Cooner . This is in
keeping with zoning discussions held with the city several years
ago , whereby my ultimate plan is to remove the three bedroom
houses at 305 and 309 Cooner as well as the houses discussed
above and replace them with a 12 or 16 unit apartments .
My plan is to remove the houses at 303 and 307 Cooner with
student labor this summer and build the storage building this
summer or next summer .
I ask that I be granted six months to accomplish this removal .

Chairman Jim Holster called the meeting to order stating that the
Board was meeting to consider a request from Foress Johnson. The
request was to move a house located at 1313 Peale St. in Bryan to
a lot on Thompson Street in College Station.
Building Official Coy Perry stated he had sent Building Inspector
Wes Castolenia and Electical Inspector Robert M. Williams to
inspect the house. Pictures that were taken of the house were
displayed on a bulletin board for the Board to review. Mr. Perry
stated he could not allow the house to be moved into College
Station because of the condition of the house. He stated the
house had been condemned by the City of Bryan at one time and
then someone was issued a permit to rehab the house. He stated
no work was done and that the house needs to be repaired
electrically, there is no sheetrock inside, there is no
insulation and no vapor barrior , the windows need to be caulked.
The roof needs to be jacked up because it has a slope and will
not drain.
Mr. Johnson along with his building contractor Ronnie Watson
explained what they would do to bring the house up to Code and
also stated that they wanted to move the house to 408 Thompson .
Brenda Ryan ask about the time frame to bring the house up to
Code. Mr. Watson stated it would take approximately 90 days or
less. Mr. Perry pointed out that the City of College Station has
a new Energy Code which would require more repairs to the house.
Mr. Watson stated that the house is about 800 to 900 square
feet and he had done houses that were in 50% worse shape than
this one and had brought them up to Code.
Mr. Sears stated that the problem he had with bringing the house
into College Station that the day it is brought in and placed on
the lot it is in violation of the Ordinance the Board is to
enforce.

Both Brenda Ryan and Ed McDow spoke of the bad experience the
Board has had before with other structures like this in the
City of College Station.
Mr. Sears again stated that his main concern was that the house
would not meet the Code when moved into College Station and based
on this, he moved to uphold Mr. Perrys decision to deny the
request from Mr. Johnson to move the house into College Station.
Motion was seconded by Brett Henry. The motion carried by a
vote of 4 to 1 . Brenda Ryan voted against the motion.
Both Mr. Sears and Mr. Henry suggested to Mr. Johnson and Mr.
Watson that they could bring the house up to Code while still in
Bryan and there would be no problem. Mr. Sears stated an
exception could be made concerning the sheetrock because of the
fact that it would crack when the structure was moved.
In other business, Mr. Perry stated he would bring a problem with
two structures on Fairview to the Board at a later date.
There being no further business, Mr. Sears moved to adjourn.
Motion was seconded by Mr. McDow. The meeting was adjourned.

Chairman Holster called the meeting to order stating that
Mr. Perry and other board members had contacted him about
the Board meeting for this hearing. He ask Mr. Perry to
explain.
Mr. Perry stated that the Board members should have a copy of a
letter from Mr. Johnson asking that he be allowed to put up a
cash bond so that he might move a structure from Bryan to the
City of College Station , this being the same structure discussed
at the Boards last meeting.
Mr. Henry ask Mr. Perry to explain the position of the City as
far as the bond is concerned.
Mr. Perry stated he had not talked to anyone but he assumed it
would work the same as one other case.

Assistant City Attorney Banks explained to the Board what was
required of the other case. She stated they had a Mr. Moore sign
a declaration of judgment that the building was a nuisance at
that time and that if it was not completed by a certain date it
would be torn down by the City and the bond Mr. Moore put up was
for the amount the demolition would cost the city.
Mr. McDow ask Mr. Perry when he would review the plans for the
improvement of the structure. Mr. Perry stated he would as soon
as the structure was moved , that a moving permit would be issued
first and then a building permit would be issued after the
structure was moved. Mr. McDow also ask if the structure could
be brought up to standards and Mr. Perry replied any structure
can be brought up to standards and he also added, "if it is
feasible to do this. "
Mr. Johnson explained his reason for offering to put up a cash

that the money 4ould be in the City's hands if he failed to do as
he has promised. The City would have the money to pay somebody
to go out and do the work.
Chairman Holster questioned whether the Board was in a position
to grant something like this. He again stated that the Boards
main concern at the last meeting was the fact about bringing in a
sub-standard building into the City. He stated that he did not
believe the City should get into anything like this, that it did
not require a bond like this with any other building in the City.
Mr. Henry also expressed concern that the Board should not get
into anything like this, that the Board had taken everything into
consideration.
Mr. McDow stated he did not believe that the Board was in a
position of taking responsibility for Mr. Johnson 's money.
Mrs. Ryan stated that she believed Mr. Johnson 's intentions were
to do as he said but that as a Board the fact remained that the
structure did not meet code and would not meet code when moved
into the city and that other people in the neighborhood had to be
considered also.
After further discussion Mr. McDow moved to sustain the last vote,
the last action at the last meeting. Mr. Henry seconded the
motion and ask the Chairman to open it for discussion , the motion
sustained , as in , stand behind the Board 's previous decision. The
Board voted 3 for and 1 against the motion. Brenda Ryan voted
against the motion. The motion carried with Mr. Holster stating
the Board stood behind their original decision.
Mr. Holster ask that there be a policy review about the moving of
structures in the City. He stated the Board does not want sub-
standard houses brought into the City.
Mr. Henry ask if there could be an addendum made too the Code
by the Board.
It was decided that the Board would have a 2 hour workshop session
in about three weeks.
There being no further business, Chairman Holster declared the
meeting adjourned.
