HomeMy WebLinkAbout2016-3845 - Ordinance - 12/08/2016 ORDINANCE NO. 2016-3 845 AN ORDINANCE AMENDING CHAPTER 3, "BUILDING REGULATIONS", SECTION 3.6.A.1, "INTERNATIONAL BUILDING CODE ADOPTED", CHAPTER 12, "UNIFIED DEVELOPMENT ORDINANCE", SECTION 12-6.5.E.1, "PORTABLE STORAGE STRUCTURES", AND CHAPTER 12, "UNIFIED DEVELOPMENT ORDINANCE", SECTION 12-7.5.J, "COMMERCIAL BANNERS," OF THE CODE OF ORDINANCES OF THE CITY OF COLLEGE STATION, TEXAS REGARDING APPLICATION AND REGISTRATION FEES; PROVIDING A SEVERABILITY CLAUSE; DECLARING A PENALTY; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: PART 1: That Chapter 3, "Building Regulations", Section 3.6.A.1, "International Building Code Adopted" of the Code of Ordinances of the City of College Station, Texas be amended as set forth in Exhibit "A" attached hereto; that Chapter 12, "Unified Development Ordinance," Section 12-6.5.E.1 "Portable Storage Structures," of the Code of Ordinances of the City of College Station, Texas,be amended as set out in Exhibit"B" attached hereto; that Chapter 12, "Unified Development Ordinance," Section 12-7.5.J, "Commercial Banners," of the Code of Ordinances of the City of College Station, Texas, be amended as set out in Exhibit"C" attached hereto. PART 2: That if any provisions of any section of this Ordinance shall be held to be void or unconstitutional, such holding shall in no way affect the validity of the remaining provisions or sections of this Ordinance,which shall remain in full force and effect. PART 3: That any person, firm, or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not less than Twenty-five Dollars($25.00)nor more than Two Thousand Dollars ($2,000.00). Each day such violation shall continue or be permitted to continue,shall be deemed a separate offense. Said Ordinance,being a penal ordinance, becomes effective ten (10) days after its date of passage by the City Council, as provided by Section 35 of the Charter of the City of College Station. ATTEST: APPR OV .,..1. / il City Secreta a r APPR• IV,�;►�: City Attorney 2 ORDINANCE NO. 2016-3845 Page 2 of 4 EXHIBIT "A" That Chapter 3, "Building Regulations," Section 3-6, "International Building Code Adopted", Subsection 3.6.A.1 of the Code of Ordinances, City of College Station, Texas, is hereby amended to read as follows: "A. The above referenced International Building Code is hereby amended as follows: 1. Section 105 (Permits) is amended by adding Section [A] 105.1.3 to read as follows: [A] 105.1.3 Registration of Contractors. It shall be the duty of every individual who makes contracts to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure, or to erect, install enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical, or plumbing system, the installation of which is regulated by this Code, or to cause any such work to be done, and every individual making such contracts and subletting the same or any part thereof, to first register with the Building Official, giving full name, residence, name and place of business, and in case of removal from one place to another to have made corresponding change to the Building Official. Exception: Homeowner permits as provided for by local amendment to the International Residential Code. Plumbing Contractors - Plumbing contractors shall be licensed as prescribed by the State of Texas and shall register their license with the City of College Station before a plumbing permit is issued by the City. Air Conditioning, Refrigeration and Heating Contractors - Air Conditioning, Refrigeration and Heating Contractors shall be licensed by the State of Texas and shall register their license with the City of College Station before a mechanical permit is issued by the City. Licensed Irrigators-Irrigation Contractors shall be licensed Irrigators by the State of Texas shall register their license with the City of College Station before a lawn irrigation permit is issued by the City. Electrical Contractors - Electrical Contractors shall be licensed by the State shall register their license with the City of College Station before an electrical permit is issued by the City. Electrical Sign Contractors—Electrical Sign Contractors shall be licensed by the State shall register their license with the City of College Station before a permit is issued. Before any license is registered with the City, the applicant shall pay a registration fee as established from time-to-time by resolution of the City Council and have adequate insurance coverage for general liability as provided for by State law for the respective trade." ORDINANCE NO. 2016-3845 Page 3 of 4 EXHIBIT "B" That Chapter 12, "Unified Development Ordinance," Section 12-6.5.E.1 "Portable Storage Structures, General Provisions" of the Code of Ordinances, City of College Station, Texas, is hereby amended to read as follows: "E. Portable Storage Structures. 1. General Provisions. a. A permit shall be obtained prior to placing a Portable Storage container on property unless otherwise exempted herein. b. The following are exempt from the requirements of this Section: 1. Property with an active building or development permit. 2. Properties zoned M-2, Heavy Industrial or BPI Business Park Industrial. M-2 Heavy Industrial and BPI Business Park Industrial that abut residential zoning districts or uses shall comply with this exemption. 3. Sites in which storage containers constitute a principal use, as determined by the Administrator. 4. Containers that receive site plan approval as per 3.b, Development of a Permanent Storage Container Area, of this Section. c. Placing material on top of, or the vertical stacking of, Portable Storage containers is prohibited. d. Permits shall be posted on the storage container. If a container is replaced by another during the permit period, the permit shall be removed and placed on the newly placed container. If the container is visible from a right-of-way, then the permit shall be posted in view of the right-of-way. e. Storage containers shall be placed outside of right-of-way and the sight triangle as established in Section 12-7.2.C, Visibility at Intersections in all Districts. f. Storage containers shall be placed on an improved surface as specified in Section 12-7.3.F, Off-Street Parking Standards, Surfacing. g. In the event of a natural disaster of extenuating circumstance, the Administrator may grant that a permit be extended up to thirty (30) additional days. h. An application for permit of a storage container shall be accompanied by a fee as established from time-to-time by resolution of the City Council." ORDINANCE NO. 2016-3845 Page 4 of 4 EXHIBIT"C" That Chapter 12, "Unified Development Ordinance," Section 12-7.5.J "Commercial Banners" of the Code of Ordinances, City of College Station, Texas, is hereby amended to read as follows: "J. Commercial Banners. 1. A Commercial Banner: a. Shall be in good repair; b. Shall have the permit number conspicuously posted in the lower right hand corner of the banner; c. Shall be allowed in addition to the signage provided for in Section 12-7.5.1, Attached Signage; d. Shall advertise only the name of, uses of, or goods or services available within the building or tenant lease space to which the sign is attached; e. Shall be mounted parallel to the face of a building or permanent structure; f. Shall not be located within public road right-of-way of the State of Texas or the City of College Station; g. Shall not obstruct any window, door, stairway, or other opening intended for ingress or for needed ventilation or light; and h. Except for J.2. below, shall be allowed for a maximum fourteen-day period per permit. 2. An annual banner permit may be allowed for places of worship meeting in public spaces on a temporary basis. Banners allowed by this Section shall only be displayed on the day of the worship service. 3. The applicant shall pay an application fee as established from time-to-time by resolution of the City Council upon submission of a banner permit application to the City. The application fee is waived for a non-profit association or organization. This fee shall not apply to banners associated with special events as provided for in Section 12-7.5.X, Special Event Signs."
