HomeMy WebLinkAbout2016-3842 - Ordinance - 11/21/2016 ORDINANCE NO. 2016-3842 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, CANVASSING RETURNS AND DECLARING RESULTS OF THE GENERAL ELECTION, FOR THE PURPOSE OF ELECTING A MAYOR AND A CITY COUNCIL MEMBER PLACE 2, AND CANVASSING RETURNS AND DECLARING RESULTS OF THE SPECIAL ELECTION TO FILL A VACANCY FOR THE TWO YEAR REMAINDER OF THE UNEXPIRED TERM OF OFFICE OF COUNCILMEMBER, PLACE 4, AND THE ONE YEAR REMAINDER OF THE UNEXPIRED TERM OF OFFICE OF COUNCILMEMBER, PLACE 3, BOTH HELD ON NOVEMBER 8, 2016 RECITALS: 1. On July 28, 2016 the City Council ordered that a General and Special Election be held on November 8, 2016 for the purpose of electing a Mayor and City Councilmember, Place 2, and to fill a vacancy in the office of Councilmember, Place 4, for the two year remainder of the unexpired term of that office, and in the office of Councilmember, Place 3, for the one year remainder of the unexpired term of that office. 2. Notice of this election was duly published in The Eagle on October 13 and 17, 2016 and in La Voz Hispana on October 14 and 21, 2016. 3. A copy of the notice was posted on the bulletin board at City Hall on September 2, 2016. 4. This election was duly and legally held on November 8, 2016, in conformity with the election laws of the State of Texas, and the results of the election have been certified and returned by the proper judges and clerks. 5. The City Council of the City of College Station, Texas with the following members present: Mayor Nancy Berry, Councilmembers Blanche Brick, Steve Aldrich, Karl Mooney, John Nichols, Julie Schultz, and James Benham have today considered the returns of the General and Special Election held on November 8, 2016. 6. It appears to the Council, and the Council finds, that the election was in all respects lawfully held. 7. It appears to the Council, and Council finds, that the tabulation of the results of the election is correct. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: Ordinance No. 2016-3842 Page 2 of 3 SECTION 1. The General and Special Election of November 8, 2016 was duly called, notice of the election was given in accordance with law, and the election was held in accordance with law. SECTION 2. The tabulation of votes cast in the General and Special Election held on November 8, 2016, for the purposes stated in Recital 1 above, a copy of which is attached to and made a part of this ordinance. is adopted as the official tabulation of the votes cast at the election, and the tabulation will be filed and recorded in the official records of the City of College Station as the official canvass of the election. SECTION 3. The official canvass of the returns of the election reflects the following: A. For the position of Mayor, the following votes were cast: Karl P. Mooney 11,505 John Nichols 11,115 B. For the City Councilmember, Place 2: Jerome Rektorik (unopposed) 18,721 C. For the one year remainder of the unexpired term of Councilmember, Place 3: Linda Harvell 12,683 Jeremy Osborne 9,426 D. For the two year remainder of the unexpired term of Councilmember, Place 4: Joe R. Guerra Jr. 9,186 Barry Moore 12,661 SECTION 4. That Karl P. Mooney received a majority of the votes and is elected to serve as Mayor; that Jerome Rektorik (unopposed) is elected to serve as City Councilmember, Place 2; that Linda Harvell received a majority of the votes and is elected to serve as Councilmember, Place 3; and that Barry Moore received a majority of the votes and is elected to serve as Councilmember, Place 4.
