HomeMy WebLinkAbout1947-0109 - Ordinance - 12/17/1947ORDINANCE NO. 109 AN ORDINANCE AUDITING AND ALLOWING ESTIMATE, AUTHORIZING THE DELIVERY OF WARRANTS THEREFOR, AND DECLARING AN EMERGENCY. WHEREAS, the City Council of the City of College Station, Texas, has here- tofore, for and on behalf of the said City, entered into a oertain contract with C. L. Andrews, of Bryan, Texas, for the construction of a oombined city office and warehouse for said City, said contract being dated the 13th day of November, 1947; and WHEREAS, the City Council of the City of College Station has heretofore, by ordinance duly and legally adopted on the 19th day of November, 1947, ratified and confirmed said contract and authorized the issuance of CITY OF COLLEGE STATION PUBLIC BUILDING WARRANTS, in the aggregate amount of $20,978.60, for the purpose of paying the contract price of the said C. L. That said Estimate No. 1 of C. L. Andrews, Contractor, in the net sum of $15,859.80, for the construction of a combined city office and warehouse for said City, in accordance with contract between said Contractor and said City, dated November 13, 1947, be, and the same is hereby approved and allowed. 2. That, in accordance with said contract, there shall be executed and delivered to said Contractor CITY OF COLLEGE STATION PUBLIC BUILDING WARRANTS, Numbers 2 to 22, inclusive, in the denomination of $750.00 each, aggregating $15,750.00, dated November 15, 1947, bearing interest at the rate of 3% per annum, payable May 15, 1948 and semi-annually thereafter on November 15 and May 15 in each year, being part of an issue of warrants authorized to be issued for the purpose of evidencing the indebtedness of the City of College Station for the contract price for the construction of a combined city office and warehouse for said City, in accordance with contract between said City of College Station and C. L. Andrews. 3. The City Council has inspected the work as covered by said Estimate No. 1 and hereby accepts the same as being in accordance with said contract; that said C. L. Andrews has complied with all terms and conditions of said contract and are entitled to receive said warrants Numbers 2 to 22, inclusive, aggregating $15,750.00, in payment of said Estimate No. 1; and that the excess of $109.80 as shown by said Estimate No. 1 shall be carried forward to the next Estimate of the Contractor. 4. That the City of College Station has received full value and considera- tion for said Warrants Numbers 2 to 22, inclusive. 5. The fact that it is necessary to arrange for the payment of said Estimate without delay, and an urgent necessity exists for the City Council to act at once, creates an emergency and an imperative public necessity that the rule requiring ordinances to be read at more than one meeting of the City Council be suspended, and that this ordinance be passed and take effect as an emergency measure, and shall be in full force and effect immediately from and after its passage and approval.
