08-9-90-4 - Resolution - 08/09/1990 RESOLUTION NO. 8-9-90-4 A RESOLUTION REQUESTING THE TEXAS MUNICIPAL LEAGUE TO URGE THE LEGISLATURE TO REPEAL SECTION 42.12 OF THE PENAL CODE. . WHEREAS, v~cious dogs pose a threat to the members of society by way of potential physical harm, possibly even death; and WHEREAS, while the penalty for violating this Section is a Class B misdemeanor, the code section is ineffective and fails in any way to act.as a deterrent to irresponsible owners of vicious dogs, and WHEREAS, any municipal ordinances of a stricter nature are superceded by this Section of the Penal Code, therefore making stricter penalties impossible for municipalities to enforce; and WHEREAS, the penalty for keeping a vicious dog while not being in compliance with this Section should be enforceable; NOW, THEREFORE, BE IT RESOLVED by the City of College Station City Council that the delegates assembled at this 7R~_h Annual Conference of the Texas Municipal League urge the Legislature to repeal Section 42.12 of the Penal Code.
