09-12-91-2.8 - Resolution - 09/12/1991RESOLUTION NO. 09-12-91-2.8 A RESOLUTION ESTABLISHING FEES TO BE CHARGED AND COL- LECTED TO REIMBURSE THE CITY OF COLLEGE STATION FOR ITS EXPENSES IN RELATION TO OIL, GAS, AND OTHER FLUIDS USED OR PRODUCED IN CONNECTION WITH OIL AND GAS OPERATIONS; TRANSPORTATION AND INJECTION PIPELINES; FOR RENTAL VALUE OF STREETS, ALLEYS, EASEMENTS, AND OTHER PUBLIC PROPERTY; FOR CONSTRUCTION AND INSPECTION PERMITS; AND FOR STREET, ALLEY OR PUBLIC PROPERTY CROSSING PERMITS; ESTABLISHING A NEW SCHEDULE OF FEES TO BE CHARGED AND COLLECTED; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, there are various pipelines (the "Pipeline Systems") within the City of College Station which pro- duce, gather, collect, receive, transport, inject, and store oil, gas and other fluids used or produced in connection with oil and gas operations; WHEREAS, the Pipeline Systems within the City of Col- lege Station are unobtrusive and effective means to transport large volumes of fluid; WHEREAS, the Pipeline Systems within the City of Col- lege Station may be expanded; WHEREAS, the City of College Station has and continues to incur expenses in the administering, maintaining records, supervising inspections, and regulating the use and maintenance of the pipelines and related facil- ities located within the jurisdiction of the City of College Station; and WHEREAS, the City of College Station should be reim- bursed through various fees for expenses incurred or property used; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION THAT: Resolution No. 09-12-91-2.8 Page 2 The fee to be charged and collected on the first day of February of each and every year for each license, right-of-way agreement, or pipeline franchise granted to produce, gather, collect, receive, transport, in- ject, and store oil, gas, or other fluids used or pro- duced in connection with oil and gas operation, in, out of, and through the City of College Station, Brazos County, Texas, for the expenses of the City involved in administering, maintaining records, supervising inspec- tions, and regulating the use and maintenance of the Pipeline Systems and related facilities within the jurisdiction of the City of College Station shall be as follows: Total number of feet of pipeline installed and in use, but including projects under construction, in use $ 0.35/ft The fee to be charged and collected on the first day of February of each and every year for each license, right-of-way agreement, or the pipeline franchise granted for the fair rental value of the streets, alleys, easements, or other public property owned or controlled by the City of College Station that is uti- lized for the purpose of laying the Pipeline Systems within the jurisdiction of the City of College Station shall be as follows: Total number of feet of pipeline, including projects under construction, in use and occupying City-owned or controlled property $ 1.50/ft The operator of a Pipeline System may deliver or cause to be delivered to the City Secretary a certificate which shall certify that the volume of water being transported by the Pipeline System being operated by such operator within the City of College Station ex- ceeds fifty-five percent (55%). Commencing the year in Resolution No. 09-12-91-2.8 Page 3 which certification is made, and upon and after such certification, and so long thereafter as such certifi- cation remains true and correct, the fees set forth in Sections 1 and 2 above shall be forty-five percent (45%) of such fees. Prior to the construction of any Pipeline System or facilities for the purpose of producing, gathering, collecting, receiving, transporting, injecting, and storing of oil, gas, and other fluids used or produced in connection with oil and gas operations, in, out of, or through the City of College Station, Brazos County, Texas, a Construction and Inspection Permit application must be submitted and a fee paid to the City Manager or his designee, and the fee shall be as follows: Total number of feet of pipe to be installed as specified in the application $1.00/ft Se Prior to the construction of any Pipeline System for the purpose of producing, gathering, collecting, re- ceiving, transporting, and injecting of oil, gas, or other fluids used or produced in connection with oil and gas operations in, out of, or through the City of College Station, Brazos County, Texas, across any street, alley or public property owned or controlled by the City, a Crossing Permit Application must be submit- ted and a fee paid to the City Manager or his designee and the fee shall be as follows: Each individual crossing $25.00 Prior to the abandonment, temporary abandonment, or reactivation of any Pipeline System, or any part thereof, for the purpose of producing, gathering, col- lecting, receiving, transporting, and injecting oil, gas, or other fluids used or produced in connection with oil and gas operations in, out of, or through the Resolution No. 09-12-91-2.8 Page 4 City of College Station, Brazos County, Texas, an Abandonment/Reactivation Permit Application must be submitted and a fee shall be paid to the City Manager or his designee for each such Abandonment/Reactivation Permit, and the fee shall be: Each occurrence $40.00 This resolution shall be effective immediately upon passage.
