07-11-91-1.3 - Resolution - 07/11/1991RESOLUTION NO. 7-11-91.1.3 A RESOLUTION AUTHORIZING THE MAYOR, CITY MANAGER AND CITY ATTORNEY TO ACQUIRE 1.08 ACRES IN THE SOUTHWOOD VALLEY SECTION 24F SUBDIVISION FOR USE AS STREET RIGHT- OF-WAY BY THE CITY OF COLLEGE STATION, TEXAS. WHEREAS, the City of College Station having determined the necessity of providing public access between Deacon Drive and Rock Prairie Road in the City of College Station; and WHEREAS, the City Council having determined that it is necessary to acquire the property described in Exhibit "A" attached to this Resolution, and that the public need requires the acquisition of same in such manner as to make the property available for lawful use for such purposes; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of College Station that the property described in Exhibit "A" attached hereto shall be acquired by the City; and the reasonable cash market value of same shall be determined and paid according to law, either by voluntary purchase or by condemnation; and that the City Manager, the Mayor, and the City Attorney are authorized to take any and all necessary actions to obtain and pay for such property, including the mar- ketable fee simple title thereto, free and clear of any restrictions or covenants inconsistent with the use of same for all lawful purposes. Further, that the City Attorney is by this resolution expressly authorized to initiate and pursue condemnation proceedings and any other necessary litigation incident to the purpose herein set forth. Southwood Valley section 24F Crawford Burnett League College Station, Texas 12 March 1991 All that certain tract or parcel of land lying and being situated in the Crawford Burnett League in College Station, Brazos County, Texas, being a part of that 103.2 acre tract conveyed to Area Progress Corporation by deed recorded in Volume 778, Page 71 of the Official Records of Brazos County, Texas, and being more particularly described as follows: Beginning at the intersection of the southeast line of Deacon Drive and the northeast line of Welsh Avenue which is also the most westerty corner of Southwood Valley section 25C addition to the City of College Station, Texas, according to plat of record in Volume 830, Page 419 of the Official Records of Brazos County, Texas. Thence S 47' 51' 35" E - 675.15 feet along the southwest line of the said Southwood Valley section 25C to the most southerly corner of same in the northwest line of that tract conveyed to Peoples Mortgage Company of Llano by deed recorded in Volume 587, Page 220 of the Deed Records of Brazos County, Texas; Thence S 42' 06' 32" W - 70.00 feet along the northwest line of the said Peoples Mortgage Company tract; Thence N 47' 51' 35" W - 675.18 feet parallel to and 70' from the southwest line of Southwood Valley section 25C to the southeast line of Deacon Drive; Thence N 42' 08' 25" E - 70.00 feet along the southeast line of Deacon Drive to the Point of Beginning and containing 1.08 acres of land more or less.
