12-10-92-3.22 - Resolution - 12/10/1992~.~"',.'*-'~- ~'~ WITH BORROWING PROCEEDS ~'~' '~ ~ Ih, ir I ,~; RESOLUTION NO. 12-10-92-3.22 :~ .,. : ~ WHEREAS, the City of College Station, Texas (the "Issuer") desires to pay for capital l,'!~..(expenditures in connection with the design, planning, acquisition, construction, equipping, and/or ;',- >-.~--'; renovating the project or facilities described in Exhibit A attached hereto (the "Project"); ,--%~:-"'__.. , ,,, ;.~,~-. _ , . ~ WHEREAS, Article 717k-6, Vernon's Texas Civil Statutes, as amended ("Article 717k-6"), permits /! the Issuer to use the proceeds of bonds to reimburse the Issuer for costs attributable to the Project paid i ~;'' on incurred before the date of issuance of the bonds; and WHEREAS, the Issuer finds, considers, and declares that the reimbursement of the Issuer for the ~'.~Q3.:; payment of such capital expenditures will be appropriate and consistent with the objectives of the Issuer's---- .----'- chooses to declare its intention, in accordance with the provisions of Section.~...-.,,,, programs and, as such, 1.103-18 of the Treasury Regulations, to reimburse itself for such payments at such time as it issues obligations to finance the Project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF COLLEGE STATION, TEXAS THAT: .... Section 1, This Resolution declares the intention of the Issuer to reimburse the expenditures for~.'~ ~ the Project with the proceeds of a borrowing. The Issuer presently intends to reimburse the expenditure:y.~,)}, by incurring debt the interest on which is excludable from gross income under section 103 of the Internal ,~;.-~. Revenue Code of 1986, as amended. Section 2. The Issuer reasonably expects to incur debt, in one or more series of obligations, .=r--.- with an aggregate m,nimum pdnc,pal amount now est,mated to be equal to $ 2,000,000 for the purpose of ~?~ paying the costs of the Proiect. A portion of the proceeds received by the Issuer in an amount estimated not to ex.ed $245,000, are reasonably expected to be used to reimburse the 1994 General Obligation Fund from which such capital expenditures are expected to be made for the Prelect. Section ~. The Issuer intends that this Resolution satisfy the official intent requirement set forth -~. in Section 1.105-1~ of the Treasury Regulations and evidences its intentions under Article 717k-8. EXHIBIT 'A' Property Description BID #93-14 Enhancement and upgrade to IBM AS/400 mainframe computer system, including the following: DISK DRIVE - 6.8 gigabytes of mirrored drive space (for a total of 13.6 gigabytes) with imbedded caching controllers containing 16 megabytes of cache each. TAPE DRIVE - 5 gigabyte capacity rack mounted tape drive with minimum acceptable expandability to 10 gigabytes, compatible with IBM data compression controller model 2621. MEMORY FOR E45 - 32 megabytes of main memory for a model E45 AS/400. SYSTEM UPGRADE OF IBM AS/400 FROM MODEL B45 TO MODEL E45 - Includes E45 a6 MB of Memory and 1.28 Gb Disk, feature conversion, main storage exchange, upgrade of software processor group from Group G5 to G6.
