CITY ATTORNEY TO ACQUIRE 0.222 ACRES IN THE MORGAN
·-~' RECTOR LEAGUE FOR USE AS A DRAINAGE EASEMENT. ~'-:.
%,,,..-.~,-~ WHEREAS, the City of College Station having determined
"~';-?,.' the necessity of widening and improving Krenek Tap

~.. WHEREAS, the City Council having determined that it is
,.:'~- necessary to acquire the drainage easement described in ~'~-.~,,.,,"
.... Exhibit "A" attached to this Resolution, and that the
~'~.~,:.~'.. public need requires the acquisition of same in such
manner
as to make the property available for lawful use
for such purpose; ! .....

~ 'r:'-.' NOW, THEREFORE, BE IT RESOLVED by the City Council of
,,-..,, the City of College Station that the property described
..-'., in Exhibit A attached hereto shall be acquired by the
· ,. City; and the reasonable cash market value of same
~.._~.~ .~,: shall be determined and paid according to law, either }!')~'~!'
by voluntary purchase or by condemnation; and that the
,;-.;~3 City Manager, the Mayor, and the City Attorney are
\/'~,: - . authorized to take any and all necessary act ions to
..... obtain and pay for such property, including the mar-
'-J~' ketable fee simple title thereto, free and clear of any ~'~
~.~"'i'""~4 restrictions or covenants inconsistent with the use of

Drainage Easement No. 2
0.222 Acres
Being all that certain tract or parcel of land lying and being
situated in the MORGAN RECTOR LEAGUE, Abstract No. 46, in College
Station, Brazos County, Texas, and being a portion of the 49.09
acre tract of land conveyed to Hattie Kapchinski by partition deed
dated February 9, 1984 and recorded in Volume 650, Page 518 of the
Official Records of Brazos County, Texas, and being more
particularly described by metes and bounds as follows:
COMMENCING: at a 1/2-inch iron rod found marking the intersection
of the northeast line of the said 49.09 acre tract and the new
south right-of-way line of Krenek Tap Road (based on a 60' width),
said iron rod also being in the southwest line of the City of
College Station 47.22 acre tract described in Volume 398, Page 383
of the Deed Records;
THENCE: S 42" 30' 00" W for a distance of 46.87 feet along the
southeast line of the said new line of Krenek Tap Road to a 1/2-
inch iron rod set for the POINT OF BEGINNING;
THENCE: S 32° 30' 00' E into the interior of the said 49.09 acre
tract for a distance of 100.00 feet t'o a 1/2-inch iron rod set for
corner;
THENCE: S 42° 30' 00" W for a distance of 100.00 feet to a 1/2-
inch iron rod set for corner;
THENCE: N 32° 30' 00' W for a distance of 100.00 feet to a 1/2-
inch iron rod set for. corner, said corner also being in the
beforementioned new southeast line of Krenek Tap Road;
THENCE: N 42° 30' 00" E for a distance of 100.00 feet to the POINT
OF BEGINNING and containing 0.222 acres of land, more or less.
