04-22-93-2.14 - Resolution - 04/22/1993RESOLUTION NO. 4-22-93-2.14 A RESOLUTION OPPOSING H.B. 1209, H.B. 99P5, AND S.B. 412, REGARDING COMPONENTS OF INCOME TAX EXPENSES USED FOR ESTABLISHING UTILITY RATES. WHEREAS, three bills, specifically H.B. 1209, H.B. 2225, and S.B. 412, have been introduced in the Texas Legislature which will have an adverse impact on City of College Station utility ratepayers and ratepayers across the State of Texas; and WHEREAS, the proposed legislation seeks to require the income tax component used ~n establishing utility rates to be based upon "hypothetical tax," not "actual tax." This allows a utility to recover income taxes from ratepayers which the utility may never be required to pay; and WHEREAS, such legislation is an attempt to circumvent the adoption of the actual tax method by the Public Utilities Commission and the Texas Railroad Commission; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of College Station that it opposes H.B. 1209, H.B. 2225, AND S.B. 412, regarding components of income tax expenses used for establishing utility rates.
