08-8-96-7-b - Resolution - 08/08/1996q sofution RESOLUTION NO. 8-8-96-7-b A RESOLUTION SETTING THE SCHEDULE OF DRAINAGE CHARGES FOR THE CITY OF COLLEGE STATION, TEXAS, MUNICIPAL DRAINAGE UTILITY SYSTEM AGAINST ALL REAL PROPERTY WITHIN THE CITY OF COLLEGE STATION, TEXAS, SUBJECT TO THE REQUIREMENTS OF TEXAS LOCAL GOVERNMENT CODE CH. 402.041, ET SEQ., SUBCHAPTER C; AND PROVIDING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. WHEREAS, the City Council of the City of College Station, Texas, on the 27th day of June, 1996, adopted Ordinance No. 2187, creating and establishing a municipal drainage utility system to protect the public health and safety from the loss of life and property caused by surface water overflows and surface water stagnation; WHEREAS, on the 8t h day of August, 1996, the City Council of the City of College Station, Texas, amended Chapter 11, of the Code of Ordinances of the City of College Station, Texas, to establish regulations governing the rules for the operation and conduct of the municipal drainage utility system within the boundaries of the City of College Station, Texas, pursuant to the authority vested in it by 'lEx. LOCAL GOV'T. CODE {}402.041, et seq.; WHEREAS, the City Council of the City of College Station, Texas, finds that the basis for the drainage charges set forth herein is directly related to drainage; WHEREAS, the City Council of the City of College Station, Texas, in setting the schedule of charges for drainage services set forth hereinbelow, has based its calculations upon an inventory of the parcels, lots, and tracts located within the municipal boundaries; WHEREAS, in setting a schedule of charges for drainage service, the City Council of the City of College Station, Texas, has considered the uses made of the benefited properties, using official zoning maps of the City of College Station, Texas, for that purpose, and has also considered size and topography of the parcels of benefited property in assessing the drainage charges set forth hereinbelow; WHEREAS, the City Council of the City of College Station, Texas, finds that the schedule of charges set forth hereinbelow, and the rates set upon which such schedule of charges was calculated, are equitable for similar services in all areas of the City of College Station, Texas; RESOLUTION NO. 8-8-96-7-b Page 2 WHEREAS, the City Council of the City of College Station, Texas, has held a public hearing on the charges levied and imposed herein, after publishing notice of such public hearing, all in the manner proscribed by TEX. LOCAL GOV'T. CODE {}402, Subchapter C; and WHEREAS, the City Council of the City of College Station, Texas, now desires to prescribe and establish fees, together with the assessment, levy and collection thereof, to finance and fund such municipal drainage utility system; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS: That the basic drainage charges to be levied on a monthly basis are as follows: A. Single Family Residential rate $3.50 per month. B. Multi-Family Residential rate $1.57 per month. II. All other lots, tracts and parcels of land within the City of College Station, Texas, shall be considered and charged on the basis of the commercial use in accordance with the follow- ing schedule of drainage charges which are hereby levied against all such remaining lots, tracts or parcels of land within the City of College Station, Texas: A. Land Use Square footage B. Commercial $1.65/1000 sq.fi./month III. This resolution shall be in full force and effect from and atter the 1 s t. day of October ,1996.
